i 29. The ownership of the entry of the property off of Fleming Street must i be resolved prior to any permits being issued. The Department of Public Works must be satisfied with the ownership resolution. '30. City streets and alleys are to be kept clear of dirt and debris at all times during construction. Dust suppression and street cleaning must i occur as directed by the Public Works Inspector. ;31. Performance guarantees are required for public street and utility improvements. 32. A one—year guarantee is required on the public street and utility i system for an amount not less than 10% of the cost of construction and shall run for one year from the date of issuance of the first Occupancy Permit for the project. ! 33. On —site water main will be staked within an easement to the City. The easement will be submitted to the City prior to issuance of permits. 34. As—builts of storm sewer, sanitary sewer, and water systems will be required to be submitted in the form of the original approved , construction plan or photomylar and shall be submitted within 30 days of connections. i 35. Any modifications to the instant application determined to be substantial by the Planning Director shall activate additional hearings ; by the City's Hearing Examiner to amend the site plan. •36. The Applicants and the City of Everett shall stipulate to a requirement for Occupancy Permits for each of the lots on the subject property. No Occupancy Permits may be granted until it is determined that the Applicants have met the conditions for development of the lot. 37. Approval of this Special Property Use Permit is contingent upon the i successful vacation of Cady Road. The Everett City Council shall make that determination. !
