3. The subject property is zoned as 1h�lerironl Commercfal (WC)wilh Planned <br /> Development Overlay (PDO). The WC zone encourages watertronl commercial <br /> activity, and marine shipping and lransporialion facilities are permitted uses in <br /> lhis zone. Because the subjed property is in the shoreline, it has been revlewed <br /> as part of the Everett Shoreline Master Program (ESMP). The shoreline <br /> designation for lhe site is Urban Marilime. The proposed uses are pemrtted <br /> uses in this designation. The site is bordered by an existing marina to the south, <br /> the Snohomish River to the west, and a new marina and boat yard to the north. <br /> The site is currently used for a variety of rrrarina relaled uses and water and non- <br /> waler relaled indusl�ial and commercial uses. Pursuanl to lhe State Environmental Policy Act (SEPA) (RCW 43.21 C), the <br /> Applicant was designated as lead agency for the identffica6on oi environmental <br /> impacts resut;ing (rom the proposed projecl. The Applicant issued a notice of <br /> adopllon of an exisling Environmental Impact Statement (EIS)for the North <br /> Marina Redevelopment Projecl. The EIS was originally issued on May 27, 2005, <br /> and examined the environmental impacts of the project and included studies of: <br /> Collins Building Adaptive Reuse Study, Geotechnipl Reporl;Air Quality Report; <br /> Biological Evaluation; Phase#1 Environmental Site Assessment, Phase #2 <br /> Environmental Siie Assessment, Historic and Cuitural Resources Assessment, <br /> and Collins Building Economic and Financial Analysis of Development Scenarios. <br /> The EIS was independenlly reviewed upon its issuance and was determined to <br /> be an adequate review of the environmental issues relaling to the project. There <br /> have been no appeals of the EIS, and there were no appeals of the Appttqnt's <br /> adoption ot the EIS as the environmental document for this project. The project site is within the jurisdiction of lhe ESMP for the Cily of Everelt and is <br /> subject to the provisions of the Shoreline Managemeni Act (SMA) RCW 90.56. <br /> SMA policies are provided in RCW 90.58.020 and InGude allowances for all <br /> reasonable and appropriale uses, development thai promotes or enhances the <br /> public interest, and protection against adverse impacts. The primary goal of the <br /> SMA is lo protect the public's interest al a statewide level in the State's <br /> shorelines through a coordinaled management and development process. The <br /> SMA allows for all reasonable and appropriate uses of the shoreline in a manner <br /> that would promote and enhance the pubiic interest. Permitted uses in the <br /> shorelfne are to be designed and developed in a manner that would minimize any <br /> resulting damage to lhe ecology and environment o(the shoreline and any <br /> interterence with the pu6lic's use of Ihe water. The ESMP envisions <br /> development of ihe urbanized parls of lhe City's shoreline. (ESMP) <br /> 6. The sub'ect property has been lhe subjeci of previous Shoreline Permils. In <br /> 20D4 a �horeline Permit was issued to authorize replacement of a (ailing <br /> buikhead along ihe south shoreline oi ihe site. in 2005, a Shoreline Permit was <br /> issued for the 12th Sireet Marina to the norlh which included a porlion of Ihe <br /> esplanade improvements.
