9. Pursuant to the ESMP, the sub�ecl property is designated as Urban Maritime and <br /> is a shorelir.e of statewide significance. The ESMP envisions development of <br /> urbanized paHs of the City's shoreline thal promoles a baiance behveen <br /> �conomic div��.rsificalion, recreational opportunities, and environmental protection <br /> restoralion of�he shoreline. (ESMP Sectron 1.1-Community Vision) The <br /> purpose of lhe Urban Mariiime designation is to provide areas ,`�r intense <br /> developmenl of maritiine activities while protecting and restoring ecoloDical <br /> functions. The ESMP provides generai and sperific regulations to which proposed projecls <br /> rtwst comply. Section 3 of the ESMP provides general regulations/restrictions <br /> that all development wilhin Ihe shoreline jurisdic6on must adhere to such as <br /> noise and Ilghting (ESMP Section 3.2), cultural and archeologicai preservation <br /> (ESMP Section 3.5), public access (ESMP Section 3.7), and environmental <br /> protection and conservation (ESMP Secfion 3.9). Section 5 of the ESMP <br /> addresses regulalions for activilies wilhin the shoreline jurisdictions such as <br /> commercial deveiopment (ESMP Sectlon 5.5), industrial development (ESMP <br /> Section 5.7J, parking (ESMP Section 5.12), recreation (ESMP Section 5.13), <br /> signage (ESMP Section 5.15), solid wasle (ESMP Section 5.16), and utillties <br /> (ESMP Section 5.18) <br /> 11. Shoreiine Use Requiremenls are established in Section III of the ESMP. The <br /> Shoreline Use Efement indudes a provision that all extertor tighting and lighting <br /> oi signs be dfrected downward onto the sile and away from olher shoreline <br /> properlies in the neighborhood. The City staff in fts review implemented this <br /> requirement as parl of its recommendalion (condftions 29 and 30). These <br /> conditions require the exlerior lighling be designed to shield and focus light wilhin <br /> ihe project sile and minfmize light and glare impacts to nearby residences. Also, <br /> lhe project must compty with lighting miiigation measures that are part of lhe <br /> Final EIS issued by ihe Applicanl. These include use of non-re0eclive building <br /> materiais and locating, orienting, and designing buildings to minimize glare and <br /> shadow impacts on sensitive areas. (exhibit 1-staftreport) <br /> 12. The Cultural Resource Element is required for review of all Shoreiine Permits for <br /> Urban Maritime projects. The City has recommended a condition that requires <br /> lhe Applicant or ils developers io slop work and notify the City and the Tulalip <br /> Tribes if ai.�thing of possibie archaedogical interest is uncovered during <br /> excavation or development. The Applicani would be required to consult a <br /> professional archaeologist to inspecl and evaluale the sile and comply with this <br /> requiremenf. (exhibit 1-stalfreport) <br /> 13. Within lhe City of Everett siles, landscaping plans must be included which are in <br /> scale and harmony with the proposed structures and provide screening and <br /> bufiering of acUvities, if appropriate. The City in reviewing the ApplicanYs plans <br /> indicated thai Ihe landscaping should be consislent with the urban characler oi <br /> ihe development. The landscaping would provide shade, augmenl the aesthetics <br /> of the deve!opment, and prowde a unified character for the projecl. It would also <br /> buf(er porliuns oi lhe boalyard area from other areas. The Iandscaping design <br /> guidelines and slandards were part of the Cily Councit's agreement in this project <br /> ��� <br />
