The proposal has been reviewed subje�t to the Stale Environmental Policy Act <br /> (RCbV 43.21.C). An EIS was prepared, and it analyzed lhe probable adverse <br /> environmenlal impacls. It was adopled by lhe City after an inJependent review. <br /> It was determined that lhe proiect and environmenlel issues had been <br /> adequately revlewed. The EI� provides for sufiicient measures to ensure <br /> impacis to the environment were mitigaied so as not to rise above the level of <br /> significance. With adherence to the conditions ot approval, as set forlh herein, <br /> as well as the Development Agreement and all requiremenls of the EIS, the <br /> projecl woulJ not adversely fmpact the environment. (findmgs 4, 29, 30) <br /> DECISION <br /> Based upon the preceding Findings of Fact and Conclusions and testimony and <br /> evidence submitted at the public hearing, it Is hereby ordered that lhe Shaeline <br /> Substantial Development Permit (SMA#05-009) for activity identified herein is granted <br /> subJect to ihe conditions as sel forlh below. This Shoreline Permit is for a mixed-use <br /> 65-acre development of residential, retail, oNice, restaurants, lodging, and marina <br /> support uses on lhe Pori Gardner Wharf on the wesl side of Wesl Manne View nrive <br /> (1100-1600 Blocks)in Everelt Washington. The conditions as listed herein are <br /> consistent with the numbered condilions as recommended by the Cily or submitted by <br /> the Applicant. There have been some minor edits for darily purposes. <br /> General <br /> 1. The proposal must comply with all City code and ordinance requirements nol <br /> specifically sel (orih herein. <br /> 2. Construciion, or substantial progress toward consiruclion, of a project in reliance <br /> of lhis Shoreline Pertnil must be I,1pd��laken w�hin tw y�r7i5.after final approval <br /> of the permit, and compleled within len year.
