A portion of Site 1 is zoned B-2, with a concomitant agreement or ' <br /> contract that regulates development of the site, alang with the <br /> requirements of the 1956 2oning Cade, as amended. A copy of the <br /> concomitant agreement is enclosed for your information. The rezone <br /> contract provides, in part, the following: <br /> 1. Public Works and Planning Department must approve all <br /> detailed drawings prior to issuance of any permits. <br /> 2, Access to Merchant Way and Meadow Way is not permitted <br /> • unless the City determines such access is warranted, and the <br /> street improvements are installed. One 'pedestrian only' <br /> access is permitted in a location approved by the Public Works <br /> Department. <br /> 3, Any pervious arees to be newly paved must meet drainage <br /> • standards for the capacity of the existing 7 2 inch storm drain <br /> from the wetlands. <br /> � 4. A ten (101 foot landscaped buffer must be provided along <br /> Merchant Way and Meadow Way. Some of the vegetation in <br /> this huffer is dead or inadequate. Supplemental plantings of <br /> trees, shrubs and groundcover should be provided. I <br /> 5. The twenty-five 125) toot buffer around the wetland must Se <br /> maintained in an undisturbed conditio�. <br /> 6. Signage is regulated by Section 9 of the coniract. � <br /> 7. Parking lot lighting shall be designed to avoid intrusion into the <br /> residential areas, and minimize glare on adjacent roadways. <br /> 8. A five 151 foqt wide landscaped buffer shall be provided along <br /> the north•south leg of EI Capitan. A �andscaping plan for this <br /> area was previously approved, but has not been implemented. <br /> 9. A minimum of 596 of the parking area shall be landscaped. <br /> Landscaping shall consist of a minimum of six evergreen trees <br /> or shrubs for each 100 square feet of required landscaping. In <br /> addition, groundcover shall be provided which shali attain a <br /> coverage of 90% within three years of planting. <br /> Policies and zoning regulations adopted after approval of the 8-2 <br /> zoning with the concomitant agreement would require much greater <br /> landscaping standards than required in the B-2 with contract zoning. <br /> Mitigation measures for the park and ride lot should inciude <br /> requirements for substantially greater landscaping that required in the <br /> contf2ct along all property frontages, especially the frontages adjacent <br />
