The site is relatively level with the access easement oft oi cngland Avenue; oniy <br /> the most northem and eastem portions of the property consist of steep slope areas. No <br /> additional environmental features are associated with this site. <br /> i <br /> The applicant has retained the services of Robert M. Pride, Inc., Principal Geotechnical <br /> Engineer, to provide specific recommendations for construction and earthwork to be done <br /> on the site. The findings and conclusions of this land use a�proval are based upon the <br /> report prepared by Mr. Pride dated March 26, 2002. <br /> U�der the City of EveretYs Zoning Code a setback of 25 feet is typically required from the <br /> ridgP or"top of bank" for projects proposed in steep slope areas. The applicant is <br /> proposing to construct a attached garage within this 25' buffer. The typical 25' bufler has <br /> already been modifled as lhere is an existing carport and shed in the location proposed for <br /> new constructfon which were constructed in 1968. Based on the date of their construction <br /> they predate the environmentaily sensilive area ordinance adopted by the City of Everett. <br /> All new structures are required to meet the 25' buHer requirement or seek a modiflcation <br /> through the Cfry Planning Department. The proposed garage would be setback further <br /> from the top of bank lhan the structures existing on site. <br /> FINDINGS AND CONCLUSIONS: Section 37.040.D of the Everett Zoning Code <br /> designates slopes of 40% or greater as an environmentally sensitive feature. Section <br /> 37.080.B requires a 25' buffer (rom the top of the slope. Section 37.080 allows the <br /> Planning Director to authorize the alteration of a slope or its buffer if he approves a <br /> geotechnical report which demonstrates that: <br /> 1. The proposed development will not cre�te a hazard to the subject property, <br /> surrounding properties or rights-of-way, erosion or sedimentation to off-site ' <br /> properties or bodies of watPr; and <br /> �� <br />
