The criteria for expansion of non-conforming uses are set forth in EMC 19.38.090.
These criteria, which have been identified in the staff report, have been reviewed by
the Haring Examiner in his deliberations. The proposal is consistent with these
criteria and satisfies them. The manner in which these criteria are satisfied have
been addressed in the findings of this document which are adopted as support of
this decision.
3. Beceuse the expansion will result in an addition that is greater than, or equal to,
35% of the assessed value, there shall be a need for landscaping of the subject
property. The landscaping plan, as submitted by the Applicant, will adequately
address this issue.
4. Adequate parking exists for the expansion of the facility.
