Phase I: Food Market (Haggan's) <br />Haggan's shall conduct noise monitoring after the food market is occupied at�d <br />in normal operation and shall eubmit the noise monitoring reports to the City <br />of Everett Planning Lepartment. The noise monitoring reports shall te <br />pregared by a certified noi�e conau].tant and ahall become part of t!�e <br />environmental review record. At the conclusion of the mcnitoring perir�d, <br />(whrch shall be no longer than six months in duration, from the date of <br />issuance of the occupancy permit), the r.oise report shall contain recommerided <br />mitigation measures which must be taken to insure that operation of the <br />Haggan'� Food Market is in compliance with City and State Noise Co�;a <br />requirements. Aaggan's shall implement the noise mitigation meaeures <br />contained in the report. <br />Additionally, prior to the issuance of an occupancy permit for the food <br />market, Haggan's shall post a bond in an amount to be determined by the Public <br />Works Department, which shall insure that mitigation of worst case noise <br />impacts can be implemented. (These noise impacts and mitigaeion measures are <br />documented in [he existing-noise study submitted by Haggan's). <br />' — - --- — <br />----- _------ - <br />�f -- -- - ._------------ - <br />Rhase II: Home Center and Drug Store (Ernst and Pay 'n Save) <br />The home center and drug store shall comply with the previously defined <br />requirements of Item 13, Noise Mitigation, in the "Final Declaration of <br />Non-Significance" issued on August 9, 1983; or alternatively shall conduct <br />naise monitoring, implement mitigation measures based upon the monito:ing <br />reports (in compliance with procedures required above for the Phase I portion <br />of the project), and post a bond based upon the costs of mitigating w+orst case <br />noiae impacts generated by the home center and drug store. The bond amount <br />shall be based upon the noise analysis submitted by Haggan's unless the hom.e <br />center and drug store submit a new noise sCudy for that portion of the site <br />within whic�the� uses are located. <br />Variance Procedure <br />Additicnally, for either Phase I or Phase II, a variance from City and State <br />Noise Code requirements may be requested by the owners: the noise variance <br />(if granted by the Noise Code Administrator) would relieve the owners of <br />implementing mitigation measures required to insu�e compliance with City and <br />State Noise Code re�utrzaents prior to such time as development actually <br />occurs on the vacant residenLially zoned property to the north. At such time <br />as the vacant property to the north of the shopping center develops, the Phase <br />I and Phase II owrv:r would be required Co implement mitigation measures to <br />insure compliance with City and State Noise Code requirements. <br />
