Once the building permit has t^.en issued, the city will require the <br />posting of a 100 percent landscape bond so that in the event that the <br />property owner defaulted on the construction of the landscape, the city <br />would construct the required improvements by utilizing the funds set <br />aside by the bonding. <br />3. The city can also withhold a Certificate of Occupancy for the building in <br />order to ensure that the landscape is constructed per the approved plan, <br />and at this stage of the development, the developer is usually highly <br />motivated to complete the project due to the substantial financial <br />expenditure which is required to bring the development to this stage of <br />completion. <br />I trust that this outlines, in a very detailed manner, the proposed landscape <br />treatments along Third Avenue. Clearly, the developer has made a substantial effort to <br />address the concerns of the community, and through the permit review process, there <br />are, and will be, substantial guarantees that adequate landscape will be provided along <br />Third Avenue. You will also note that the proposed measures are in excess of the <br />minimum city code requirements, however, the developers and major users of the project <br />are substantial property developers and wish to be good neighbors. We believe that the <br />construction of the shopping center will ultimately result in an increase in the property <br />values of the surrounding single-family residential properties due to the convenience <br />afforded by the shops and major user, Target Inc. <br />Should you have any further questions with regard to these matter, please feel <br />free to call me.
