5 <br /> 4. Landscape Maintenance Responsibility: The following requirements must be <br /> satisfied prior to final plat approval: <br /> a. Except as provided in Subsection 4(b) (below), until the time a certificate <br /> of occupancy is issued for a lot, or a sale is made to a homeowner, the <br /> maintenance of all landscaping and street trees on any lot within the <br /> proposed project shall be the responsibility and expense of the Applicant, <br /> developer, builder, or property owner. Upon the issuance of a certificate <br /> of occupancy or the sale, the maintenance responsibility shall transfer to <br /> the homeowner. A covenant setting forth the maintenance responsibility <br /> shall be submitted by the Applicant to the City for review and approval. <br /> The submittal shall not be later than when final plat approval is requested <br /> by the Applicant. Upon approval, the covenant shall be recorded with the <br /> Snohomish County Auditor setting forth the maintenance responsibilities. <br /> b. Until the time certificates of occupancy are issued for all of the lots within <br /> the proposed project, or all lots are sold to homeowners, the maintenance <br /> of all common landscaped areas within the proposed project shall be the <br /> responsibility of the Applicant, developer, builder, or property owner. <br /> When the certificates are issued for all of the lots within the proposed <br /> project, or sales of all of the lots are complete, the maintenance <br /> responsibility shall transfer to the homeowners. A maintenance program <br /> ensuring the long-term viability and maintenance of the vegetation shall be <br /> prepared and presented to the City for review and approval. Such review <br /> and approval must be submitted prior to final plat approval. Upon <br /> approval by the City, a covenant shall be recorded with the Snohomish <br /> County Auditor setting forth the maintenance responsibilities for all <br /> common landscape areas within the proposed project. <br /> 5. Building Design/Unit Type: Final building designs and unit types shall be <br /> reviewed by the Planning/Community Development Department. They shall be <br /> designed consistent with the preliminary approved building designs and <br /> elevations and shall include the following: <br /> a. 11 Single Family Detached Donovan Homes (lots 1-11); and <br /> b. 9 Single Family Detached Homes (lots 12-20) meeting EMC 19.7.010 <br /> (Small Lot Development Standards); and <br /> Final building plans shall be consistent with the approved final site plan, <br /> preliminary building elevations and design. The Donovan homes are to be <br /> developed on lots 1-11 and are to be consistent with the approved final site plan, <br /> preliminary building elevation and design.
