The subject property fronts Lombard Avenue on which public transportation is <br /> available. There is an existing bus route nearby. (exhibit 1, page 5) <br /> 16. In addition to lhe General Evaluation criteria for Special Property Use Permits, <br /> the Specific Evaluation criteria as set forlh in EMC 41.150.D.2.b. pertdining to <br /> church facilities must be satisfied. Those criteria inciude: <br /> (1) New church structures shall be locaied a minimum of fifteen feet from <br /> adjacent residentially zoned properties. <br /> (2) Church buildings shall comply with the height requiremen!s of the zone in <br /> which it is located. Sleeples may exceed the maximum building height. <br /> (3) Where churches are located adjacent to local residential streets the <br /> parking lot entrances/exits shall be oriented toward the nearest collector <br /> or arterial street. <br /> 17. The subject properiy is not a new church structure but an expansion of an <br /> existing structure and is not subject to the fifteen foot separation requirement. <br /> The structure is over fifteen feet away from residentially zoned properties. <br /> (exhibit 1, pac�e 5) <br /> 18. The proposed addition complies with all height requirements. (exhibit 1, page 5) <br /> 19. The existing church has two driveways which will be continued to be used. <br /> There would be no change in the access. (exhibit �, pape 5) <br /> 'L0. No public iestimony was submitted at lhe I�earing. <br /> Jurisdiction: The Hearing Examiner of the City of Evereft has jurisdictional authority to <br /> hold a hearing and to issue the decisior.. That authority is set forth in EMC 15.16.100. <br /> Based on the above Findings of Fact, the Hearing Examiner enters the following <br /> Conclusions: <br /> � CONCLUSIONS <br /> I 1 .
