3. The proposal has been reviewed pursuant to the Shore!ine Act of the State of <br />Washington; WAC 173-19-001 at seq.; and the Snohomish County Shoreline <br />Master Program. The proposal is consistent with the criteria as set forth in these <br />documents. <br />4. The proposed project is within 200 feet of the Snohomish River and will involve <br />improvements that exceed $2,500. The project is subject to shoreline review. <br />5. The proposal creates recreational facilities. The recreational facilities have been <br />designed to take advantage and enhance the character of the shoreline. With <br />limited vehicular access (only the boat launch), the fragile shoreline will be <br />protected. <br />6. All signs to be placed on -site will be consistent with the sign regulations for the <br />Rural Environment designation. <br />7. Adequate landscaping with appropriate vegetation material will be provided. The <br />parking facilities will comply with Federal and State water quality laws. Adequate <br />surface water runoff is proposed for the site. <br />8. The proposal satisfies all specific regulations for development of recreational <br />facilities in a Rural Environment as set forth in the Snohomish County Shoreline <br />Master Program. <br />9. The proposal satisfies the Rural Floodway District Zoning designation of the subject <br />property. This District allows the proposed use. <br />10. Conditional Use Standards for the development of the restroom facilities have been <br />reviewed. The standards, as set forth in EMC 19.30.030.D.2 and identified in the <br />staff report, are satisfied. The manner in which they have been satisfied is <br />addressed in the staff report and these reasons are adopted as conclusions in <br />support of the decision. <br />11. The restroom facility will have a low flood damage potential; will allow for minimum <br />obstruction to the flow of floodwaters; will be firmly anchored to prevent flotation; <br />and will have electrical and heating equipment constructed two feet above the <br />regulatory flood protection elevation. In addition, the structure will satisfy all the <br />Federal regulations for floodways as set forth in Title 44, CFR 60.3 and EMC <br />19.30.050. <br />12. All wetlands will be identified and delineated. Adequate mitigation of destroyed <br />wetlands will result. <br />13. The proposed design is the only design that can adequately improve the property <br />without being destructive to the watland area. It will also provide access to the <br />Snohomish River and to the shoreline, a significant shoreline within the State of <br />Washington. <br />6 <br />
