DECISION <br />Based upon the preceding findinc;z of facts and conclusions, testimony and evidence <br />submitted at the public hearing, and upon the impressions of the Hearing Examiner of a <br />site view, it is hereby ordered that the Shoreline Management Substantial Development <br />Permit for the development of Rotary Park, as defined in the introduction of this document, <br />be approved subject to the following conditions: <br />Construction or substantial progress toward construction of the project must be <br />undertaken within two years after final approval of the Shoreline Permit and <br />completed within five years. If the project has no, been completed in this time span, <br />the Shoreline Permit will be reviewed by the Planning Department who will do one <br />of following: extend the permit for one year or terminate the permit. <br />2. The Applicant shall provide a bike rack and picnic table near the restroom where <br />the trail ends. <br />3. Post "Environmentally Sensitive Area" signs along the edge of the parking lot, trail, <br />and driveway where they abut the edge of Wetland "A" or its buffer. Approximately <br />one sign for every 250 feet shall be required. The signs are available from the City <br />of Everett Planning Department. <br />4. The Applicant shall remove the hydrocarbon -impacted soils as recommended in the <br />Kleinfelder Environmental Site Assessment Study. <br />If any possible archeological data is uncovered during the excavation or <br />development of this project, the Applicant must notify the City of Everett Planning <br />Department immediately at 259-8731. Failure to comply with this condition shall be <br />considered a violation of the Shoreline Permit. <br />6. The Applicant shall provide a wetland mitigation plan that is acceptable to the City <br />of Everett Planning Department. The mitigation plan must not only include the <br />creation of the new wetland but also the revegetation of disturbed buffer and a <br />monitoring plan. <br />7. Prior to grading, the Applicant shall provide a temporary construction fence around <br />the areas that are not to be disturbed. <br />8. The Applicant shall monitor the site for a five-year period. Monitoring shall include <br />a baseline survey after completion of construction of the wetland and buffers and an <br />assessment of success at the end of the first, second, and fifth years. <br />9. A Public Works Permit is required for this project. <br />10. Detailed drawings in accordance with City Development and Construction <br />Standards shall be submitted to the Public Works Department showing site parking <br />layout, landscaping, utilities, storm drainage, and temporary construction erosion <br />control, and all required improvements in the public right-of-way. Public Works <br />Department approval of these drawings is required prior to any permits being <br />issued. All improvements shall be completed and approved warranted before the <br />Occupancy Permit is issued. <br />7 <br />
