Box <br /> 2577, Lynnwood, WA 98036 for a Planning Director's Determination <br /> on what constitutes reasonable use of the property located at <br /> 216/218 Madison Street. A substantial portion of this site has <br /> been designated as "environmentally sensitive. " Subsection <br /> 37.160.D. 3(d) of the Zoning Code contains a provision for <br /> allowing development to occur within a required minimum buffer <br /> for streams and wetlands. The Planning Director, using Review <br /> Process II.B, is authorized to " . . .approve, disapprove or approve <br /> with conditions the use proposed by the applicant" (Subsection <br /> 41.100.B) . If no appeal is filed in response to the Planning <br /> Director's determination, the decision will be considered final. <br /> If an appeal of the decision is filed, such an appeal must be <br /> submitted to the City's Hearing Examiner. As a property owner <br /> within 300 feet of the subject property, this notice is to inform <br /> you that the Planning Director has issued a determination on the <br /> proposed action as described below. <br /> BACKGROUND: The subject property is located at 216/218 Madison <br /> Street. The property is zoned R-2, Single-Family Residential, <br /> High Density. The proposed action is to construct a <br /> single-family residence with a footprint size of approximately <br /> 1,900 square feet. Total lot area is 8,460 square feet; lot width <br /> is 45 feet. The proposal would entail reduction of a required <br /> stream buffer from 25 feet to 12 feet, as measured from the <br /> property line. In exchange for reduction of the stream buffer in <br /> an area adjacent to the proposed residence, the City is requiring <br /> enhancement of the stream channel and stream buffer. Details of <br /> the proposal are provided in the following discussion. <br /> PTNDTN(m: The Pigeon Creek No. 2 stream channel extends in a <br /> north/south direction parallel to and approximately two feet from <br /> the west lot line. A stream study was submitted to the Planning <br /> Department as part of the application for a reasonable use <br /> determination. The stream study rates Pigeon Creek No. 2 as a <br /> Category III intermittent stream, in accordance with the City's <br /> Interim Environmentally Sensitive Areas Ordinance. Category III <br /> steams are required to have a 25 foot buffer, as measured from <br /> the top-of-bank.
