(Ord. 1671-89 (part), 1989.) <br />38.020 Continuation of use of building or <br />property. <br />If an aspect, element or activity of or on the subject <br />property 's; nanconfortning, that �tpect, element or xtiviry <br />may continue and nced not be brought into conformance <br />with this tiUe unless a specific provision o( this title other- <br />wise requims conform�nce (see the sections of U�is utle <br />conceming nonconfortning �dult use businesses in Chapter <br />39 and nonconforming signs in Chaprer 36). (Ord.1671-89 (p,vt), <br />1989.) <br />38.040 Nonconforming use. <br />A. Continuation. A nanconfortning use is tr�nsfer�ble <br />to a new owner or tenant; providcd, �hat the use is not <br />expanded or discontinueJ as providcd in subsection B of <br />this secuon. <br />cGva�cn ag2� <br />B. Discontinuabon. Ear,ept as provided in Section <br />38.100, any u.se which is nonconfortning and hac ceaced <br />tor a period of une year or mote ahdi lose such noncon- <br />fomiing stacus. All s�bsequent use of �he property a <br />building sha11 be a use which conforms with the reguire- <br />menls of Ihis litle. <br />C. Change in Nonconforming Use. A noncuntortning <br />use may tx changed to another nonconCortning use iCsuch <br />use is approved using Review Pracess IIB. In making such <br />a decision.lhe review au�hairy stull cauider the fallowing <br />criteria in detertnining whelher to approre or deny a changa <br />in nonconfortning use: <br />1. Residendal Zones: <br />a. Except as prwided in Section 38.100. a noncanfam- <br />ing nonresidential use may not be changed to another <br />nonconfortning nonresi�ntial use in yiy residential zone. <br />A nonconfotming aonresidential uu may oNy be changed <br />to a use which is permitted in the residential zone. <br />� b. A nonconfaming rcsidential use may be changed <br />[o ano�her nonconfartning msidential use only iF the pro- <br />posed use is not morc nonconforming than the Frior ase. <br />2. Nonresidential Zones: A noncontorming use located <br />in a nonresidential zone may be chviged w anott�er noncon- <br />forming use only if the proposed uu is not more noncon- <br />fortning than the prior use. <br />3. Factors to be considered in maldr,g Ihis detamin�tion <br />include trrffic gener�aon, parking demand, number of <br />employces. visu�l impact, noisc, odor. dus; and other simiL�r <br />nuisance irritants, as well as the evaluation cri�eria Iisted <br />in subsecrion 41.150C. <br />D. Ezpansion of a Nonconforming Use. Expansion <br />of a nonconfartning use may be pemiitted using Review <br />Process IIffi. The evaluation criteria which shall be consid- <br />ered durir�g the rcview of the proposed ezpansion are <br />contained in Sution 38.090. (Ord. 1571-89 (part), 1989.) <br />38.050 Noncooforming buildings aod struMures. <br />A. Altemtion or Moditication. <br />1. Additions to a nonconCortning building which do <br />not increace the noncon(ormity shall be pertnined. <br />2. Main�enance anJ minor repairs of such a noncon- <br />forming building shall be permitted: provided, th�t such <br />work does not increase Ihe nonconformiry of the building. <br />3. Where a nonconCortning building does not meet <br />thc height or setback requirements, an addition !o the <br />building may have Ihe same setback and height as the <br />existing building wi�hin thc exisUng builcling Cootprint <br />B. Damage ar llestruction. <br />t.
