r <br />a <br />All of the exhibits t�re available for inspection at the Hearing Examiners O�ce located ai <br />2930 Wetmore Avenue, Sth floor, Everett, Wasnington. <br />After due consideration of the testimony and evidence presented by the Applicant, <br />testimony and evidence elicited during the public hearing, and as the result of the personal <br />inspection of the subject property and surrounding areas oy ths Everett Hearing Examiner, <br />the following findings of fact and conclusions constitute 4he ba�is of the decision of the <br />Everett Hearing Examiner. <br />FINDINGS OF FACT� <br />The Applicant requested approval of an Expar�sion of s Non-Cor�forming Building <br />Pertnit for the property at 2301 Hoyt Avenue, Everett, Washircgton. On that prcperty <br />is a church that is a non-cor�forming structure. It is the intent of the Applicant t� <br />develo�s a new entrance, lobby and intemal circulation space for the building. <br />2. Ths structure on the s�bject property is non-cor�forming t,ecause it does not satisfy <br />the 20 foot front setback requirements for R-3 zoned property. The property is <br />zoned R-3, �dulti-Family Medium Density. <br />3. The subject property is an 18,000 square foot parcel of land on which a 14,100 <br />square foot building is developed. The proposed expansien will add an additional <br />1,054 square feet to the existing structure. <br />4. The properties to the north, south, and west are zoned R-3 and are developed with <br />single-family units. Property to the east is zoned R� and is zoned as Multi-family. <br />5. In order for a non�onforming building to be expanded, the criteria as set forth in <br />EMC 19.38.090 must be satisfied. Those criteria have been identified in the stafS <br />report in this matter. <br />6. Pursuant to the request, the City of Everett Public Worics Dopartment reviewed the <br />propo�al for potential adverse impacts on traffic and pubiic safety. None was <br />identified. The Public Works Oepartment statad that a right-of-way iease (permit) <br />will be required for the proposed steps and railings which will be locate� in ?he <br />public right-of-way. <br />7, The Applicant aurrently has off-street parking on two lots south of the ci�urch. The <br />lots hav� 29 parking stalls which adequately serve the ro3eds of tho congregation of <br />the clwrch. The proposed addition to the church will no4 result in a larger <br />congregation and will net necessitate a need for additional parking facilities. <br />8. The value of the propose� improvements will be less than 35% of the assessed <br />value of the existing structure. Pursuant tQ EMC 19.38.090(2), no �dditional <br />landscaping will be required. <br />
