The library restoration and expansion, along with the development of <br />the parking structures and the use of the temporary facilities at the <br />Medical Dental Building on the corner of California and Colby Avenues, <br />are compatible with the zoning of the area and the Comprehensive Plan <br />of the City of Everett. It will provide a use for community service <br />and will provide cultural activity for the Central Business District of <br />the City of Everett. <br />5. The proposed parking structure will reduce off-street parking and <br />create a more compatible environment in the area. <br />6. Subject to a mitigation condition of an adverse impact, as determined <br />by the City, the requested Special Property Use Permit will not have a <br />detrimental impact upon the environment. <br />7. There is a public need for the proposed facility. <br />DECISICN <br />Based upon the preceding findings of facts and conclusions, the testimony and <br />evidence submitted at the public hearing, and upon the impressions of the <br />Everett Hearing Examiner upon a site view, it is hereby ordered that the <br />requested Special Property Use Permit for the development of the library <br />restoration and expansion, a parking structure, removal of parking structures <br />and other buildings on the corner of Hoyt and California Avenues; and, a <br />temporary library facility in the basement of the Medical Dental Building. <br />The precise location of this development is set forth in the findings and <br />introduction of this document. The Special Property Use Permit is granted <br />subject to the following conditions. <br />1. The site shall be developed in general conformance with option I or II <br />site plans submitted for Phase I. All other phases shall be required <br />to do additional site clan review through the City's SEPA and SPU <br />process. A 10% deviation may be approved by the Planning Director <br />(Phase I). <br />2. The building shall be consistent with the elevations. Minor deviations <br />may be approved administratively by the Planning Director. (Phase I <br />Options I & II elevation will be same.) <br />3. A detailed landscaping plan is required for Phase I. The plan shall <br />address specific plant type used. The following areas need specific <br />attention: landscaping shall be provided on all street frontages; the <br />intent is to provide landscaping between all structures and sidewalks. <br />Additionally, street trees must be provided in sidewalk areas. <br />4. A construction and moving schcxule for Phase I shall be approved by the <br />Public hbrks Dept. to minimize impacts on parking, streets and public <br />services. <br />5. The alley right-of-way that runs through this project must be either <br />vacated or a right-of-way use permit for the alley will be required. <br />
