�. <br />The Applicant had submitted his request for a variance <br />on May 9, 1988, after being told by the City�s <br />Enforcement Officer that he was in violation of City <br />code. The Applicant requested that the hearing on his <br />v�riance applicat.ion be postponed since he was just <br />leaving to spencl the summer in Alaska. The City <br />granted Yiis request and did not proceed with <br />enforcement action pending the outcome of the variance <br />request. The City �ontacted the Applicant when he <br />returned from Alaska in September 1988 and informed him <br />that the hearing would be scheduled for October l0, <br />1988. The Applicant asked for a further postponement <br />at that time, but the City would not grant a further <br />postponement. <br />The site plan submitted with that application indicated <br />he could provide five off-street parking spaces. <br />However, it must also be noted that the site plan is <br />not totally accurate, since it shows the alley abutting <br />to the west, while actually there is a single family <br />structure abutting to the west. <br />b. Conclus;on• There are no exceptional or extraordinary <br />circumstances applying to the subject property or the <br />use thereof. The Applicant created his own hardship by <br />converting the building to a rooming house without <br />obtaining the proper permits and complying with city <br />codes. <br />�r?*e 'on No 2• <br />That such variance is necessary for the preservation and en- <br />joyment of a substantial property right of the appellant <br />possessed by the owners of other properties in the same vicinity <br />or zone. <br />fl. Flnd�nn• T}]ls structure was constructed as a single <br />family residence and provided parking to code in a two <br />car garage. The structure has been converted to a use <br />that has a much greater parking requirement, that being <br />on� space for each sleeping room, and there is not <br />enough room on the small lot to provide the parkiny. <br />There may be some uses in the area that are <br />nonconforming for parking; however, if any of those <br />uses are changed to a use that has a higher parking <br />requirement, th� new use would ba required to meet the <br />parking requirements of the zoning code. <br />The City of Everett parking requirement for rooming <br />houses is consistent with that required by other cities <br />since a survey done of other city's ordinancas shows <br />that out of ten cities surveyed, seven require one <br />parking space per sleeping room, one requires two plus <br />one per each sleeping room and two require one for each <br />two sleeping rooms. <br />A request for a vari.ance to allow an eight unit <br />apartmeat building tc be constructed at 3306 Hoyt and <br />providc� only eight parking spaces instead of the twelve <br />requiri�d by code was denied by the Board in November <br />1987. <br />b. Conclusion: Granting this variance is not necessary <br />since the applicant already possesses substantial <br />property rights �imilar to those possessed by others in <br />the vicinity and zone, and the variance is not <br />necessary for the preservation and enjoyment of t:tose <br />rights. <br />
