OF USE PERMIT <br />JUNE 6, 1989 <br />Applicant: Richard Woolworth <br />861 Lawson Road <br />Camano Island, WA 98292 <br />Project Location: 2108 Hoyt Avenue <br />Existing Use: <br />2108 Hoyt was a 3 room rooming house with a 2 <br />bedroom unit downstairs. 2108 Fioyt has been <br />illegally converted to an 8 bedroom rooming <br />house. An accessory building in the rear of <br />2108 Hoyt has been used illegally as a 4 room <br />rooming house. It is no longer occupied. <br />Both conversions have occurred without <br />required permits and in violation of Zoning <br />Code requirements. <br />Proposed Use: <br />Convert 2108 Hoyt into an 8 room rooming <br />house and the storage building into a 3 room <br />rooming house. <br />Zoning: <br />R-3, Multiple Family Low Density <br />Parking Required: <br />One parking space is required per each <br />sleeping room. (Section 19.40.020) <br />The application, as submitted, for a Use Permit (under Chapter 19.64 of the <br />Zoning Code) for 2108 Hoyt is hereby denied. The Use Permit cannot be <br />granted until the Zoning Code violations which have been identified on this <br />property (see Attachment A) and which are summarized above have been <br />corrected and because the use has been established and occupied in violation <br />of Section 19.64.020(C). However, a Use Permit application which meets the <br />following conditions will be approved, if submitted : <br />1. Submit complete applications and obtain Building permits and <br />inspections on or before June 23, 1989, for any construction <br />completed within the last 24 months or for any proposed construction. <br />2. The new occupancy for 2108 Hoyt is classified as R-1 by the Uniform <br />Building Code (UBC). The occupancy must comply with Chapter 12 <br />requirements of the UBC. This may include, but is not limited to, <br />providing emergency egress, at least one water closet with separate <br />facilities when both sexes are accommodated, smoke detectors for each <br />room, and one -hour construction separating the common laundry room, <br />storage space, and the furnace room. <br />3. All Fire Code requirements must be complied with and approval from <br />the City's Fire Marshal is required by August 15, 1989, or the <br />occupancy must be returned to a triplex. <br />4. The City right-of-way cannot be used for providing any portion of the <br />required parking. The required 8 parking spaces must be paved and <br />provided on the building, site per Public Works standards. A <br />permanent non-exclusive parking and access easement agreement between <br />the separate residential. properties of 2102-4 Hoyt and 2108 lloyt must <br />be submitted to and approved by the City by June 23, 1989. Parking <br />must be permanently avail.abLe as long its the rooming house use is in <br />existence. The easement must he recorded as a covenant which must <br />run with the titles for 2102-4 and 2108 Hoyt. <br />
