Title to the estate or interest in the subject prcperty is vested in Kevin Durch, a <br />single man pursuant to a Seller's Assignment of Contract and Deed recorcfed <br />under Recording No. 9809160744. The purchaser's interest undet the real es:ate <br />contract recorded under Recording No. 7903260059 is now held by Diamond <br />PropeRies, Inc., pursuant to QuitClaim Deed recorded under Recording No. <br />96121300GE. <br />4. Other panies with an interest in the property include the following: <br />a. The City of Everett, which is grante� of an easement recotded under Recording <br />No. 90060R�385. <br />b. Public Utility District No. 1 of SnoY.omish County, which is grar.tee of:�r. <br />ease:nentrecorded under Recording No.9107300427. <br />c. Mazshland Flood Control, which levied an assessment i;i ii,e amount of $I,I 13.51 <br />�Account No. 610-0034-5). <br />5. The subje:ct property described herein has been classified as open space disclused <br />by notice recorded November 30, 1958 under Reccrding No. 8811300042, and is <br />subject tc the provisions of RCF✓ 84.34. <br />6. Or. June 22, '.999 the parties described in Findings of Fact 3 and 4 were duly <br />notified via posting, certified mail und regulaz mail of the conditions at the subject <br />property, were given the opportunity to correct these conuiti. ns, and have liad <br />adequate notice of the opportunity tu appear at the hearing to �ippeal the City's <br />allegations. <br />Conclusions of ]�aw: <br />1. The building located upon tlie subject property is a dangerous building as defined <br />in Section 16.12A30.i3 of the Everett Municipal Code. <br />2.
