After due considerat+on of the testimony and evidence presented by the Applicant, testimony and evidence elicited during the public hearing, and as the result of the persunal inspection of the subject property and surrounding areas by the Everett Hearing Examiner, the folfowing find?ngs of fact and conclusions constitute the basis of the decision of the Everett tiearing Examiner. FINDINGS OF FACT The Applicant requested approval of a Permit for the construction of a 371 by 268 foot dairy waste storage pond east oi the existi�g bams at 3003 Larimer Road, Everett, Washingto�. The storage pond will ha�+e a 2,100,000 gallon normal fill capacity and an embankment that will be built with compacted earthen material. (Staff report, Ervine testimony) 2. The subject properry, �o�ied A-1 RFD A.gricultural Use/Rural Floodway District, is located in the Snohomisti River floodplain. Because ihe project will exceed $2,500, a Permit is required.
