The Applicant submitted that the proposal will not increase existing odors <br />which have emanated from 1he site many years bef�re any residential <br />developmertt occurred. Furth��r, according to the Rpplicant, only twn to <br />three times a year will there be odors emanating from the site. (Spane <br />testimony) <br />24. Pursuant to the State Environment,�l Folicy Act (S�PA), the City was <br />designated as the lead agency. On June 4, 1996, the City issued a Final <br />Determination of Non-Significance (UNS). As of the date of the hearing, <br />no appeal had been issued for this determination. At the date of ttiis <br />decision, no appeal has been made. (Exhibit #4) <br />Jurfsdiction: The Hearing Examiner of the Ciry of Everett has jurisa'ictional <br />auihortty to hold a hearing and fo issue the decision. That authority is set forth <br />in EMC 20.12.130. Based on the above findings, the Hearrng Exarniner enters <br />the following conGusions: <br />CONCLUSIQNS <br />1. The Applicant request�d approval of a�'ermit for the construction of a <br />371 by 266 foot dairy waste storage pc��d east of the existing bams at <br />8003 Larimer Road, Everett, Wasnington. The storage pond will hsve a <br />2,100,000 gal�on normal fill capacity and an embankrrient that wifl be built <br />with compacted earthen material. (f=inding #1) <br />� <br />
