The proposal is consistent with the environmental guidelines of the State <br />of Washington, the Ciiy of Everett, and those as set forth in the Program. <br />(Findings #8 - #21) <br />Based upon the preceding findings of ;acts and conclusions, testimony and <br />evidence submitted at the public hearing, and upon the impressions of the <br />Hearing Examiner of a site view, it is hereby ordered the requested Shoreline <br />Management Substantial Development Permit for the construction of a 371 by <br />266 foot dairy waste storage pond with a 2,100,000 gallon normal fill capacity is <br />granted for the property located east of the existing bams at 8003 Larirrier <br />Road, Everett, Washinqton. The proposal is granted subject to the following <br />conditions: <br />1. The project shall be designed and constructed to Department of Ecol�gy <br />(DOE), Natural Res��urces Conservation Service (NRCS), and US <br />Environmental Protection Agency (�PA) standards. <br />2. The hEight of ih� dike shall be determined accordir�g to the standards <br />est:blished by the Natural Resources Conservation Service and the <br />Department of Ecology. As this manure 12goon is located in the <br />floodplain of the Snohorriish River, it must be built to one foot above the <br />100 foot flood elevation, or as close to such height as is feasible <br />consistent with NRCS and DOE guidefines. <br />3. A Izndscaping plan must be provided that addresses the short term soil <br />stabilization during construction and long term vegetation maintenance. <br />At a minimum, the top and exterior faces of the lagoon dike must be <br />see�ed in grass to minimize erosion and stabilize the dike. <br />4. The App�icant sl �all develop operational procedures to address potential <br />spills of manure and other substances into the adjacent creek to the <br />south of the propcsed lagoon. These procedures must be reviewed and <br />approved by the Public Works Department prior to issuance of Building <br />Perm�ts for the project. <br />5. A maintenance plan must be reviewed and apFroved by the NRCS that <br />will provide the lony term soils stabiliry on the dike/berm material <br />surrounding the waste lagoon. <br />7 <br />
