N^W, THEREF(iiiE, the City of Everett hereby GRANTS PRELIMINARY APPROVAL of 6 lots for <br />Binding Site Plan ik05-003. The following conditions shali apply: <br />1. Lot design/configuration for this Binding Site Plan shall be as shown on the preliminary binding site <br />plan map on file with the Planning/Community Development Department. Any changes in lot <br />designlconfiguration will require approval by both Planning and Public Works Departments. <br />2. Lot 6 may be rsduced in area to less than 2 acres, subject to a revision to the Planned Development <br />Overlay Agreement that specifically authorizes this change and further, that development of this lot <br />is limited to a PUD substation. If the revisions to the agreement are not approved, then Lot 6 shall <br />maintain a minimum of 2.0 acres. <br />3. The Following shall be noted as Conditions of Approval on the Final Binding Site Plan Map: <br />a. "All future land uses shall be consistent with the zoning standards (orfhe M-1, OHice and <br />Industrial Park zone, as set /orth in Tifle 19 of the Everett Municipal Code, and Planned <br />Development Overlay Agreerrent (Rezone #99-003)." Issuance of construction permits on <br />Lot 1 is contingent upon approval of the proposed PDO revision by fhe Everett City Council. <br />b. "A soils report will be required in conjunction �vith any /uture development proposal on the <br />lots, as determined necessary by the Building Department." <br />4. The Applicant must provide for agreements for use and maintenance of common access points, <br />common parking, general circulation (drive aisles), utilities, landscaping, fencing, required fire lanes, <br />and access for all lots. These may take the form of Declaration of Covenants, Easements, and <br />Restrictions, to be recorded with or on the Final sinding Site Plan Map and shall be in a form <br />acceNtable to ihe City. A note must be placed un the final Binding Site Plan Map stating, <br />"Declaration of Covenants, Easements, and Restrictions are recorded under Auditor's File <br /># " <br />5. In the future Snohomish County PUD will likely relocate an existing 115kv transmission line through <br />the subject property. A conceptual alignment was provided as part of an earlier Special Property <br />Use Permit (II.B #11-93). Where applicable, appropriate easements for the relocated lines must be <br />provided across the affected lots within the BSP between Hardeson Road and Merrill Creek Pkwy to <br />the Glenwood Ave substation. <br />6. The project must comply with all requirements of the Planned Actio� Determination (SEPA #05-031). <br />FINAL APPROVAL OF THIS BINDING SITE PLAN shall be given subject to the satisfactory completion of <br />the above-specified requirements and improvements within three (3) years. <br />�JOTE: THERE ARE NO TIME EXTENSIONS FOR THIS BINDING SITE PLAN <br />APPEALS TO HEARING EXAMINER FOR BINDING SITE PLAN: <br />23 7 (0 <br />
