7. The Port of Everett and Maritime Trust have committed to greater public access <br /> improvements and other public improvements for the North Marina <br /> Redevelopment plan than anticipated under the conceptual site plan approved by <br /> the City of Everett in the 2003 development agreement; and <br /> 8. As a result of the ground water table issue, an interest in creating a more desirable <br /> site plan and a desire to create greater public access, the Port of Everett and <br /> Maritime Trust have identified a need to construct the residential buildings ten <br /> feet taller than permitted under the 2003 development agreement, with rooftop <br /> appurtenances on the buildings up to an additional ten feet in height; and <br /> 9. The Port of Everett, as SEPA lead agency, prepared a draft and final <br /> environmental impact statement addressing the proposed North Marina <br /> Redevelopment plan with the proposed increases in residential building height; <br /> and <br /> 10. The Port of Everett Commission selected a preferred alternative through its public <br /> process, which has been submitted to the City of Everett as the basis for the <br /> proposed amendments to the 2003 development agreement; and <br /> 11. The Port of Everett has requested that the City approve amendments to the 2003 <br /> development agreement to modify certain development standards, including the <br /> permitted building height for residential structures; and <br /> 12. The Planning Commission conducted a public workshop on September 13, 2005, <br /> to consider the rationale for the changes proposed by the Port of Everett, and did <br /> take public testimony in opposition to and in support of the proposed change in <br /> building heights; and <br /> 13. The Planning Commission, following consideration of testimony by the Port of <br /> Everett, Maritime Trust, their consultants and the public concerning the proposed <br /> changes, did request additional information, including a public demonstration <br /> using story poles to illustrate the height of buildings proposed on portions of the <br /> North Marina Redevelopment area; and <br /> 14. The Port of Everett and Maritime Trust did provide the public story pole <br /> demonstration on October 8, 2005, and did provide responses to the request for <br /> additional information by the Planning Commission; and <br /> 15. The Planning Commission held a public hearing on October 18, 2005 to consider <br /> additional information presented by the Port of Everett, Maritime Trust and their <br /> consultants, and did consider public testimony both in opposition and in support <br /> of the proposed amendment to the development agreement; and <br />
