• <br /> 477- <br /> • <br /> CITY OF EVERETT <br /> VIOLATIONS HEARING EXAMINER <br /> City of Everett, a Washington ) <br /> Municipal Corporation, ) Case No. 04-0844 <br /> ) <br /> Petitioner, ) SECOND FINDINGS OF FACT, CONCLUSIONS <br /> vs. ) OF LAW AND ORDER OF THE HEARINGS <br /> EXAMINER <br /> James Flippin ) <br /> 3310 Rucker Avenue ) <br /> Everett, WA 98201 ) <br /> ) <br /> Respondent, ) <br /> This matter having come before the Violations Hearing Examiner on March 31, 2005, in open hearing, <br /> Petitioner represented by Code Compliance officer Tamra Gregory, Respondent not appearing on behalf of <br /> himself, and the testimony of witnesses having been heard and all exhibits admitted into evidence having been <br /> considered, the Violations Hearing Examiner makes the following findings of fact, conclusions of law and <br /> order: <br /> Findings of Fact: <br /> 1. An Findings of Fact, Conclusions of Law and an Order were previously entered in this matter on <br /> January 20, 2005. <br /> 2. The January 20, 2005 Findings, Conclusions and Order remain in affect. <br /> 3. James Flippin, owner of the property located at 3310 Rucker Avenue, Everett, Washington, has met <br /> with City of Everett officials and is cooperating in abating the previously found nuisances. <br /> 4. James Flippin has caused the extermination of rodents and other pests to be accomplished as the first <br /> step toward abating previously found nuisances at 3310 Rucker Avenue. <br /> 5. James Flippin does not object to the Hearings Examiner authorizing the City of Everett to cause the <br /> abatement to be completed at 3310 Rucker Avenue, and to charge James Flippin with those costs, <br /> and to enter a tax assessment lien upon the property if those costs are not paid by James Flippin <br /> within 30 days of the entry of this order. <br /> 6. James Flippin has been provided with a cost estimate for the cleanup of the property provided to the <br /> City of Everett by Service Masters of Everett, Washington. <br /> Conclusions of Law: 13 <br /> City v.Flippin,04-0844 <br />
