4 1. The Violations Hearing Examiner has jurisdiction in this matter pursuant to Everett Municipal Code (hereinafter) 1.20. 2. Based on the Findings of Fact and Conclusions of Law entered herein on January 20, 2005, the - structure at 3310 Rucker Avenue, Everett, remains a Dangerous Building and a public nuisance pursuant to EMC 16. 12.050. Order: 1. The City of Everett shall cause the nuisance at 3310 Rucker Avenue to be abated. 2. The City of Everett shall cause the vehicles identified in the January 20, 2005 order in Findings of Fact, Paragraphs 2 a and b, a 1992 Mitsubishi Montero and a 2000 Subaru Legacy, to be impounded and removed from the property. 3. The City of Everett shall cause the cost of the abatement to be charged to James Flippin, and if not paid within 30 days of entry of this order, to be made a tax assessment lien on the property at 3310 Rucker Avenue. 4. The City of Everett shall cause any additional costs for impoundment, storage or cleanup to be charged to James Flippin, and if not paid within 30 days of entry of this order, to be made a tax assessment lien on the property at 3310 Rucker Avenue. 5. All Findings of Fact, Conclusions of Law and conditions previously Ordered on January 20, 2005 and not in conflict with any conditions of this order shall remain in affect. 6. This written Order shall be controlling over any conflicts with oral Orders issued at the Public Hearing. 7.
