GCA 6141 <br /> Master Agreement for Transportation Demand Management Work by King County • <br /> EXHIBIT B <br /> Project Equipment Provisions <br /> Section 1 <br /> General <br /> The COUNTY agrees to include these provisions in each subcontract and in all contracts it <br /> enters into for the employment of any individuals, procurement of any materials, or the <br /> performance of any Work under this Task Order. It is further agreed that these clauses shall <br /> not be modified, except to identify the subcontractor or other person or entity that will be subject <br /> to its provisions. In addition, the following provision shall be included in advertisement or <br /> invitation to bid for any procurement by the COUNTY under this Task Order: <br /> Statement of Financial Assistance: <br /> "This Agreement is subject to the appropriations of the State of Washington." <br /> Section 2 <br /> Inspection Upon Delivery <br /> The COUNTY shall inspect Project Equipment purchased pursuant to this Task Order at the <br /> time of delivery to the COUNTY. Upon receipt and written acceptance of Project Equipment, <br /> the COUNTY agrees that it has fully inspected the Project Equipment and accepts it as being in <br /> good condition and repair, and is satisfied with the Project Equipment and that the Project <br /> Equipment complies with all regulations, rules, and laws. <br /> Section 3 <br /> Reports and Use of Project Equipment <br /> A. The COUNTY agrees that-the Project Equipment shall be used as set forth in the Task <br /> Order. The COUNTY further agrees that it will not use or permit the use of the Project <br /> Equipment in a negligent manner or in violation of any law, or so as to avoid any insurance <br /> covering the same, or permit the Project Equipment to become subject to any lien, charge, or <br /> encumbrance. Should the COUNTY unreasonably delay or fail to use the Project Equipment <br /> the COUNTY agrees that it may be required to refund the entire amount of the Federal and/or <br /> state-funded share expended on the Task Order. The COUNTY shall immediately notify the <br /> STATE when any Project Equipment is withdrawn from use or when Project Equipment is used <br /> in a manner substantially different from that identified in the Task Order. If the Project <br /> Equipment is permanently removed from service the COUNTY agrees to immediately contact <br /> the STATE for instructions regarding the disposal of the Project Equipment. <br /> B. Reports. The COUNTY shall advise the STATE regarding the progress of the Work at such <br /> times and in such manner as the STATE and/or FTA may require, including, but not limited to, <br /> interim reports. The COUNTY shall keep satisfactory written records with regard to the use of <br /> Project Equipment and shall submit the following reports to, and in a form and at such times <br /> prescribed by, the STATE: <br /> GCA 6141 Exhibit B Page 1 of 3 <br />
