i <br />10. Drainage for footings and downspouts for this building must be addressed <br />on the building plans and must adhere to the geo-report. <br />11. Detailed plans for construction of the driveway and construction of any <br />retaining walls must be submitted at the time of building permit <br />application. <br />12. Provide an Environmentally Sensitive Area sign at the top of the 40% <br />slope. <br />13. Record an Environmentally Sensitive Area Covenant for the slope area <br />prior to issuance of building permits. <br />14. Record the documents "Agreement Concerning Declaration of Covenants, <br />Conditions and Restrictions" and "Declaration of Covenants, Conditions <br />and Restrictions" prior to issuance of building permits. <br />The applicant proposes to place a 4,405 square foot single-family residence <br />with a 950 square foot attached garage within 25 feet of a slope exceeding <br />40%. Subsection 37.040.1) of the City of Everett Zoning Code designates <br />slopes of 40% or greater as an environmentally sensitive feature. Subsection <br />37.080.13 requires a 25-foot buffer from the top of the slope. Subsection <br />37.080.0 allows the Planning Director to authorize the alteration of a slope or <br />its buffer if he approves a geotechnical report, which demonstrates that: <br />1. the proposed development will not create a hazard to the subject property, <br />surrounding properties or rights -of -way, erosion or sedimentation to off -site <br />properties or bodies of water; and <br />2. the proposal addresses the existing geological constraints of the site, <br />including an assessment of soils and hydrology; and <br />3. the proposed method of construction will reduce erosion potential, <br />landslide and seismic hazard potential, and will improve or not adversely <br />affect the stability of slopes; and <br />4. the proposal uses construction techniques which minimize disruption of <br />existing topography and natural vegetation; and <br />5. the proposal is consistent with the purposes and provisions of this <br />Ordinance; and <br />6. the proposal mitigates all impacts identified in the geotechnical report; and <br />
