I appreciate your <br />time and understanding. In summery I believe we discussed the <br />following: <br />* The storm water that falls on to private property is the <br />responsibility of the property owners. <br />* Private property owners can not build systems that flow from a <br />point onto their down stream neighbor's property. <br />* Even though the city built the alley way that damned up the <br />stream that used to flow through our adjacent properties, the city takes <br />no responsibility for the stream water that is now trapped in those back <br />yards. The gully was filled in nearly a hundred years ago to build the <br />alley way and utility right of way. The city does not feel that it is <br />their responsibility at this time. <br />* The stormwater that enters private property from city alley <br />ways, roads or sidewalks is the responsibility of the city. The city <br />will address those sources. <br />* Property owners in North Everett are responsible to see that the <br />stormwater that falls upon impermeable surfaces such as driveways, <br />roofs, patios, plastic sheeting and decks is transported into the city <br />combined storm and sewer system. <br />* Both my neighbors to the north and south have a system similar <br />to my sump system that collects the storm water from our yards and pumps <br />it to the storm water system as required by city ordinance. Our three <br />systems are at times overwhelmed because the three homes up hill from us <br />do not have sump pump systems for their storm water. What would you <br />suggest I do about that? <br />As we were looking at the construction site it was <br />evident that they were not dealing correctly with the rain water that <br />was falling on the plastic sheeting, driveways etc. It was also <br />evident that they were directing their stormwater plus the water <br />draining from a filled in wet land or pond to a point exit from their <br />property via a pipe. This pipe was draining onto their neighbors yard <br />which in turn was reaching my immediate neighbors yard and sump pump <br />system to the south of my property and my yard and my sump pump system. <br />It appeared to me that they needed a system to direct their storm water <br />properly into the city storm water system as required by city ordinance. <br />You mentioned berming the sidewalk along 35th street <br />adjacent to the construction project to prevent water from flowing from <br />the side walk into the gully that makes up all of our back yards. Are <br />you planning on taking action on that? <br />Please keep me informed about how the city is going to <br />address the apparent violations on the construction site on the corner <br />of 35th and Nassau Street and the progress of those corrective actions <br />including an ECD for the written notification to the contractor and the <br />contractor's corrective actions. <br />If my summery has inaccuracy's please let me know so <br />that I can better understand the situation. <br />Thank you again for your help. <br />Mark D.
