(7) Prior to the demolition or removal of any structure, side sewers or private sewer lines connected to the public sewer system shall be capped at the property line or as directed by the City's Public Works Department. (S) It is hereby expressly agreed by and between the parties hereto that in any matter, dispute, suit or proceedings arising or in any way growing out of this Contract in which it may be necessary to introduce into evidence the original of such standards, plans and specifications, that a printed copy thereof may be used in lieu thereof with like force and effect as though the original was produced. (9) The Contractor further agrees to save the Owner, the City, its officers, employees and agents harmless from all loss, damage or injury, including death, occasioned to it or to any third person or pra�erty by reason of any acts or omissions on the part of the Contractor, subcontractor, agents, employees, or persons working directly or indirectly in the performance of the Contract and shall, after reasonable notice thereof, defend and pay the expense of defending any suit which may be comnenced against the City, its officers, employees or agents by any third person alleging injury by reason of such acts or omissions and will pay any judgment which may be obtained against the City, its officers, employees or agents in such suit. The Contractor agrees to repair and replace all property of the City and property of others damaged or destroyed by himself, his employees and subcontractors and agents. This paragraph does not purport to indemnify the City against liability for damages arising out of bodily injury or death to persons or damages to property caused by or resulting from the sole negligence of the City, its officers, employees, and agents; PROYIDED, that if the claims or damages are caused by or result from the concurrent negligence of (a) the Contractor, its subcontractors, its agents or employees, and (b) the City, its officers, employees or agents, or the Owner this indemnity provision shall be valid and enforceable only to the extent of the negligence of the Contractor, its subcontractors, its agents or employees. (For example, where the Contractor is 25� liable, this indemnification shall extend to 25% of the City's concurrent negligence, if any.) (10) The Contractor expressly agrees to pay all premiums provided for by the Workman's Compensation Act of the State of Washington.
