----���■ <br />provided by law, together with a sum sufficient to defray the <br />cost of such action and to pay attorney's fees, shall be paid to <br />the Contractor. <br />(7) Prior to the demolition or removal of any structure, side sewers <br />or private sewer lines connected to the public sewer system shall <br />be capped at the property line or as directed by the City's <br />Public Works Department. <br />(S) It is hereby expressly agreed by and between the parties hereto <br />that in any matter, dispute, suit or proceedings arising or in <br />any way growing out of this Contract in which it may be necessary <br />to introduce into evidence the original of such standards, plans <br />and specifications, that a printed copy thereof may be used in <br />lieu thereof with like force and effect as though the original <br />was produced. <br />(9) The Contractor further agrees to save the Owner, the City, its <br />officers, employees and agents harmless from all loss, damage or <br />injury, including death, occasioned to it or to any third person <br />or pra�erty by reason of any acts or omissions on the part of the <br />Contractor, subcontractor, agents, employees, or persons working <br />directly or indirectly in the performance of the Contract and <br />shall, after reasonable notice thereof, defend and pay the <br />expense of defending any suit which may be comnenced against the <br />City, its officers, employees or agents by any third person <br />alleging injury by reason of such acts or omissions and will pay <br />any judgment which may be obtained against the City, its <br />officers, employees or agents in such suit. The Contractor <br />agrees to repair and replace all property of the City and <br />property of others damaged or destroyed by himself, his employees <br />and subcontractors and agents. This paragraph does not purport <br />to indemnify the City against liability for damages arising out <br />of bodily injury or death to persons or damages to property <br />caused by or resulting from the sole negligence of the City, its <br />officers, employees, and agents; PROYIDED, that if the claims or <br />damages are caused by or result from the concurrent negligence of <br />(a) the Contractor, its subcontractors, its agents or employees, <br />and (b) the City, its officers, employees or agents, or the Owner <br />this indemnity provision shall be valid and enforceable only to <br />the extent of the negligence of the Contractor, its <br />subcontractors, its agents or employees. (For example, where the <br />Contractor is 25� liable, this indemnification shall extend to <br />25% of the City's concurrent negligence, if any.) <br />(10) The Contractor expressly agrees to pay all premiums provided for <br />by the Workman's Compensation Act of the State of Washington. <br />
