(18) The Contractor agrees to pay all taxes and assessments due the <br />State of Washington or any subdivision thereof, and to furnish to <br />the City a certificate from the Tax Commission of the State of <br />Washington that all taxes, increase and penalties due from the <br />Contractor and all taxes due and to become due with respect to <br />such Contract have been paid in full. <br />(19) The Contractor shall, at his own expense, provide flagmen, shall <br />furnish all signs, barricades, guards, construction warnings, and <br />night lights in order to protect �ie public at all times from <br />injury as a result of his operations. <br />(20) The Contractor shall be responsible fcr controlling dust and mud <br />within the project limits. The Contractor shall be prepared to <br />use watering trucks, power sweepers and any other pieces of <br />equipment necessary to avoid creating a nuisance. All roads used <br />by his operation shall be thoroughly cleaned at the end of each <br />work day. Any damage caused by dust and/or mud shall be the sole <br />responsibility of the Contractor. <br />All work required by this Section shall be considered to be <br />incidental to other items of work, and no extra payment shatl be <br />made for dust and mud control. <br />(21) Any notice from one party to the other party under the Contract <br />shall be in writing and shall be dated and sig�ied by the party <br />giving such �oLice or by the duly authorized representative of <br />such par'y. Any such notice as heretofore spe�ified shall be by <br />personal delivery thereof or by depositing sar�e in the United <br />States Ma;l, postage prepaid and registered. <br />(22) In the event a claim shall be filed against the City growing and <br />arising out of the performance of the �ontract by the Contractor <br />whether baseless or not, the Ci�y shall have the right to retain <br />from the sum due the Contractor sufficient money to satisfy the <br />claim until said claim has been withdrawn or dismissed by a court <br />of competent jurisdiction. The City shall not be liable for <br />interest during the period the funds are so held. <br />(23) The Contractor should carefully examine Ru1e 171, issued by the <br />Washington State Tax Comnission, to determine wliether or not the <br />City shall be required to pay a sales tax on the work to be <br />performed, or shall be exempt from sales tax. In the event the <br />City is exempt from sales tax, then the Contractor should be <br />careful to ascertain the tax apalicable to his aurchases. <br />
