(18) The Contractor agrees to pay all taxes and assessments due the State of Washington or any subdivision thereof, and to furnish to the City a certificate from the Tax Commission of the State of Washington that all taxes, increase and penalties due from the Contractor and all taxes due and to become due with respect to such Contract have been paid in full. (19) The Contractor shall, at his own expense, provide flagmen, shall furnish all signs, barricades, guards, construction warnings, and night lights in order to protect �ie public at all times from injury as a result of his operations. (20) The Contractor shall be responsible fcr controlling dust and mud within the project limits. The Contractor shall be prepared to use watering trucks, power sweepers and any other pieces of equipment necessary to avoid creating a nuisance. All roads used by his operation shall be thoroughly cleaned at the end of each work day. Any damage caused by dust and/or mud shall be the sole responsibility of the Contractor. All work required by this Section shall be considered to be incidental to other items of work, and no extra payment shatl be made for dust and mud control. (21) Any notice from one party to the other party under the Contract shall be in writing and shall be dated and sig�ied by the party giving such �oLice or by the duly authorized representative of such par'y. Any such notice as heretofore spe�ified shall be by personal delivery thereof or by depositing sar�e in the United States Ma;l, postage prepaid and registered. (22) In the event a claim shall be filed against the City growing and arising out of the performance of the �ontract by the Contractor whether baseless or not, the Ci�y shall have the right to retain from the sum due the Contractor sufficient money to satisfy the claim until said claim has been withdrawn or dismissed by a court of competent jurisdiction. The City shall not be liable for interest during the period the funds are so held. (23) The Contractor should carefully examine Ru1e 171, issued by the Washington State Tax Comnission, to determine wliether or not the City shall be required to pay a sales tax on the work to be performed, or shall be exempt from sales tax. In the event the City is exempt from sales tax, then the Contractor should be careful to ascertain the tax apalicable to his aurchases.
