There are no physical conditions (topography, water, � <br /> etc. ) on the property which would preclude the applicant from <br /> placing the house 20 feet back. <br /> IV. QUESTIONS <br /> A. Why must the house be located 12 feet from the pro- �I <br /> perty line? Why not 13 so that it aligns with the house to <br /> the north? I <br /> I <br /> V. POS5IBLE FINDINGS n <br /> A. 'Phere are exceptional or extraordinary circumstances ' <br /> or conditions applying to the subject property or as to <br /> the intended use thereof, that do not apply generally to <br /> other properties in the same vicinity or zone, specifically: ' <br /> 1. The dwelling is located on a block where all <br /> but one of the existing houses do not meet the 20 foot set- ! <br /> back. <br /> f <br /> 2. Maple Street has a wide right-of-way for a I <br /> local access street which would most likely not be developed <br /> in the future. <br /> B. That the variance is necessary for the preservation <br /> and enjoyment of a substantial property right of the appellant + <br /> possessed by the owners of other properties in the same i <br /> vicinity or zone, specifically: <br /> 1. The applicant' s dwelling would be essentially � <br /> aligned with the dwelling to the north and setback further I <br /> than the house to the south. ; <br /> 2. The average setback for all houses on this <br /> block is 19. 5 feet. I <br /> C. That the authorization of such variance will not be ; <br /> materially detrimental to the publ.ic welfare or injurious to <br /> property in the vicinity or zone in which the property is <br /> located; specifically, for the reasons given above. I <br /> D. That the granting of such variance will not adversely <br /> affect the comprehensive general plan. <br /> VII. POSSIBLE STIPULATIONS <br /> A. That the applicant' s dwelling be placed no closer to ' <br /> the front property line than the dwelling located immediately <br /> to the north. (This stipulation would be dependent upon the <br /> applicant ' s response to the question under Section IV above . ) <br />
