6. The Army Corps of Engineers must issue a Section 10 Permit prior to any in -water <br />work activity. <br />7. Work below the ordinary high water mark will not be allowed during the "fish <br />window" as determined by the State Department of Fish and Wildlife. <br />A landscaping plan consistent with the City's Zoning Code requirements must <br />address specific improvements required, including signature trees to be placed <br />along Marine View Drive. The plan must be reviewed and approved by the City <br />prior to issuance of construction permits. Additionally, erosion controls to stabilize <br />any exposed soils caused by construction activities must be provided in compliance <br />with Public Works requirements. <br />9. All signs must comply with the current sign code. A detailed sign plan must be <br />submitted prior to issuance of any sign permits for the subject property detailing all <br />signs proposed for this project. <br />10. If any possible archeological data is uncovered during the excavation or <br />development of this project, the Applicant must immediately stop work, until all <br />necessary analysis is completed, and notify the City of Everett Planning Department <br />at 259-8731. Failure to comply with this condition shall be considered a violation of <br />the Shoreline Permit. <br />11. Piers and docks shall be designed and constructed to enable emergency <br />equipment, vehicles, and personnel to reach all surface areas of the pier. <br />12. All utilities serving this site shall be placed underground. <br />13. The Applicant should coordinate with the City of Everett Police Department Crime <br />Prevention Officer to maximize security and safety at the facility through design and <br />operation. Specific considerations could include alarm systems, security doors, and <br />"safe" landscaping design. <br />14. All facilities shall use the most up-to-date methods for water conservation (e.g., <br />faucet aerators, low -flow toilets). <br />15. Full standard street improvements are required to West Marine View Drive <br />including, but not limited to, curb, gutter, sidewalks, and street widening per City <br />Design Standards. The Port of Everett and City have signed a Memorandum of <br />Understanding regarding the allocation of six million dollars for transportation <br />improvements along waterfront. A specific element of these improvements is the <br />improvement of West Marine View Drive from 18th to 10th, to include curb, gutter, <br />sidewalk, and middle turn lane, in addition to two (2) south and two (2) north bound <br />lanes. The improvements to West Marine View Drive are expected to be completed <br />in a timely manner as to reduce any adverse impact from the proposed Landing <br />Project. <br />11 <br />
