Norton Industries <br />smh 6-87 <br />Page -2- <br />After due consideration of the evidence presented by the <br />Applicant; evidence elicited during the public hearing; and as <br />the result of the personal inspection of the subject property <br />and surrounding areas by the Everett Hearing Examiner, the <br />following findings of fact and conclusions constitute the basis <br />of the decision of the Everett Hearing Examiner. <br />The Applicant has requested approval of a Shoreline <br />Substantial Development Permit for construction of a <br />16,500 square foot building to he located at the <br />northwest corner of 1Oth Street and West Marine View <br />Drive, in the City of Everett, Washington. (staff <br />report) <br />The northwest corner of loth Street and West Marine View <br />Drive is within 200 feet of Port Gardner Bay, part of <br />Puget Sound. Because of the proximity to this body ol. <br />water, a Shoreline Substantial Development Permit is <br />required. (Ervine testimony) <br />RCW 90.58 el seq. sets forth the Shoreline Management <br />Act of 1971 for the State of Washington. RCW <br />90.58.140(2) requires that nn substantial development <br />shall be undertaken on shorelines of the State of <br />Washington without a permit from the governmental entity <br />having administrative jurisdiction. A substantial <br />development is defined as a development which the total <br />of fair market value exceeds $1,000.00, or, any <br />development which materially interferes with the normal <br />public use of the water or shorelines of the State, (RCW <br />90.58.030(3)(E). The proposed development of the <br />Applicant is a substantial development which the total <br />cost of the fair market value will exceed $1,000.00. <br />The City of Everett is the governmental entity having <br />administrative jurisdiction to determine whether the <br />Applicant should be granted a permit. (RCW, Ervine <br />testimony) <br />The Shoreline Master Plan for the City of Everett <br />controls the development of the Everett Shoreline area. <br />The Shoreline Master Program designates the subjec'_ <br />property as Urban. In the Urban designation of the <br />Everett Shoreline Master Program, commercial development <br />is allowed. (staff report, Shoreline Master Plan) <br />
