Norton Industries smh 6-87 Page -2- After due consideration of the evidence presented by the Applicant; evidence elicited during the public hearing; and as the result of the personal inspection of the subject property and surrounding areas by the Everett Hearing Examiner, the following findings of fact and conclusions constitute the basis of the decision of the Everett Hearing Examiner. The Applicant has requested approval of a Shoreline Substantial Development Permit for construction of a 16,500 square foot building to he located at the northwest corner of 1Oth Street and West Marine View Drive, in the City of Everett, Washington. (staff report) The northwest corner of loth Street and West Marine View Drive is within 200 feet of Port Gardner Bay, part of Puget Sound. Because of the proximity to this body ol. water, a Shoreline Substantial Development Permit is required. (Ervine testimony) RCW 90.58 el seq. sets forth the Shoreline Management Act of 1971 for the State of Washington. RCW 90.58.140(2) requires that nn substantial development shall be undertaken on shorelines of the State of Washington without a permit from the governmental entity having administrative jurisdiction. A substantial development is defined as a development which the total of fair market value exceeds $1,000.00, or, any development which materially interferes with the normal public use of the water or shorelines of the State, (RCW 90.58.030(3)(E). The proposed development of the Applicant is a substantial development which the total cost of the fair market value will exceed $1,000.00. The City of Everett is the governmental entity having administrative jurisdiction to determine whether the Applicant should be granted a permit. (RCW, Ervine testimony) The Shoreline Master Plan for the City of Everett controls the development of the Everett Shoreline area. The Shoreline Master Program designates the subjec'_ property as Urban. In the Urban designation of the Everett Shoreline Master Program, commercial development is allowed.
