Nonfederal permittees shall <br /> notify the Dlstrict Engineer if eny listed species or critical habitat miqht <br /> f�e affer_ted or is in the vicinity of the proiect end shall not begin work on <br /> t:fie aci:i.vity until notified by the District Engineer that the requ.irements of <br /> tl�e Endanqered Species Act heve heen satisfied and that the ectivity is <br /> autliorized. HisL•oric properties. No activity which may affect historic properties <br /> listed, or elipible for listing, in the National Register of Flistoric Places <br /> is authorized, until the District Fngineer has canplied with the provisions of <br /> 33 CFR 325, Appendix C. The prospective permittee must notify the District <br /> Enytneer if the authorized ectivity may affect eny historic properties listed, <br /> determined to be eligible, or which the prospective permittee has :eason to <br /> helieve m�y be eligible for .i�sting on the National Register of Historir <br /> �laces, and shall not begin the activity uhtil notified by the Distr.ict <br /> [nyineer that the requirements of the Nationel Historic Preservation Flct have <br /> beFn satisfted and that the ectivity is euthorized. Informetion on the <br /> location and existence of historic resources can be obtained from the State <br /> Flist:oric Preservation Office (SHPO) and the National Register of Historic <br /> Places (see 33 CFR 330.4(g)) . <br /> 13. Notification. (a) Where required by the terms of thP NWP, the <br /> pr.o.�ective G?ermittee must notify the �istrict Engineer es early as poss.it�.le <br /> and sliall not begin the a�tivity: <br /> (1) Until notified by the District Enaineer that the ar.tivity may <br /> proceed under the NWP with any special conditions imposed by the District or <br /> 9ivision Engineer; or <br /> (2) If notified hy the District or Division Engineer that an <br /> individual permit is requlred; or <br /> (3) Unless 30 days have passed from the District Fngineer's rece.lpt <br /> of thr nol:ifir.�tion and the prospective permittee has not received notice frcxn <br /> the Districl or Division Engineer.
