(b) The notification must be in writing end include the following Snformation <br /> anr.i any required fees: <br /> (1) Name, eddress, and telephone number of the prospective permittee; <br /> (7) Lor.ation of the proposed pro,ject; <br /> (3) E3rief descri�tion of the proposed proiect; the pro,ject's purpose; <br /> direr.t end indirect adverse environmental effects the pro,iect would ceuse; any <br /> oYl�er NWP(s) , regional general permit(s), or individual permit(s) used or <br /> intended to be used to authorize eny part of the proposed pro,iect or any <br /> relateci activit,y; <br /> (4) Where required by the terms of the NWP, a delineation of effe�ted <br /> special aquatic sites, including wetlands; end <br /> (5) A statement that the prospective permittee has contacted: <br /> (i) The USFWS/�1FS regarding the presence of eny federally listed <br /> (nr proposed for listing) endangered or threatened species or critical hanitat <br /> in tl�e nermit area that may be effected by the proposed pro,iect; and any <br /> available lnformation provided by those egencies. (The prospective �ermittee <br /> may cont.ar_t Corps �istrict Offices for USFWS/NMFS egency contects and lists of <br /> critical habitat.) <br /> (i.t) The SIiPO regerding the presence of any historic properties in <br /> Llie permit area ti�at mey be effected by the proposed prolect; And the <br /> availeble information, if any, provided by that egency. <br /> (r,) The standard individual permit applicetion form (Form ENG 4345) may by <br /> usec� as the noLificetion but must clearly indicate that it is a predischarqe <br /> not.f.fi.cation (PDN) a�d must include all of the information required in <br /> (b)(1)-(5) of General Conciition 13. <br /> (d) In reviPwin� an activity under the notification procedure, the District <br /> Fng.ineer. will f.irst determine whether the activity will result in more tlian <br /> minimal indivirival or cumulative edverse environmental effects or will be <br /> contr�ry tn tl�e {�ublic interest. The prospective permittee may, et his <br /> o�tion, sul�mlt a pro�osed mitigation plen with the predischarge notification <br /> to expe�ite the process end the Oistrict Engineer will consider eny optional <br /> miLination Llie ar�ilicant has included in the proposel in determi�ina whether <br /> Lhe �et edverse environmental effects of the pro�osed work ere minimal. The <br /> fl.istrict Fnaineer will consider eny comments from Federal and State agerfc.tes <br /> concerninc� t.he proposed activity's compliance with the terms and conditions of <br /> lhe NWP �nd the need for mitigetion to reduce the proiect's edverse enviton- <br /> ment:�l effects I:o e minimal ].eve.l. The District Enqineer will upon receipt of <br /> a noP.if.ication provide .immediately (e.g., facsimile transmission, overniaht <br /> matl , or other expeditious manner) a c:opy to the eppropriate offices of the <br /> I_ISFWS� State natural resource or weter quality egency, EPA, and, if appropri- <br /> ate, the NMFS. With Lhe exception of NWP 37, these agencies will then have 5 <br /> calendar days from the date the material is transmitted to telephone the <br /> 3 <br />
