Prior to certificate of <br />occupancy, a two-year landscape maintenance security as required by Title 19 <br />EMC shall be provided. <br />26. If any items of archaeological interest are uncovered during excavations or <br />development, the Applicant must immediately stop work and notify the City and <br />the Tulalip Tribes, and consult with a professional archaeologist who must <br />inspect and evaluate the site. In the event that ground disturbing or other <br />constructing activities result in the inadvertent discovery of the archaeological <br />resources, work shall be halted in the immediate area, and contact made with <br />the City of Everett, the office of the State Archaeologist (OAHP), and cultural <br />resources office of the affected Tribes. Work shall be halted until such time as <br />further investigation and appropriate consultation is concluded. In the unlikely <br />event of the inadvertent discovery of human remains, work shall be immediately <br />halted in the discovery area, the remains covered and secured against further <br />disturbance, and communication established with project administrative <br />personnel, local law enforcement, OAHP, and authorized Tribal representatives. <br />27. All development must be consistent with the requirements of Section <br />19.30.040(C) EMC, including, but not limited to, structures must be built two feet <br />above the 100-year flood elevation in flood fringe areas including the subject <br />property. <br />28. Prior to issuance of a building permit, the Applicant shall complete an elevation <br />certificate documenting the existing site elevation prior to construction and <br />finished floor elevations upon completion of construction. The first floor elevation <br />must be a minimum of two feet above the base flood elevation. <br />29. Prior to issuance of a certificate of occupancy, the Applicant shall record a critical <br />areas covenant for the protection and preservation of the buffer and wetlands. <br />30. All exterior lighting shall be shielded to prevent direct illumination and glare onto <br />adjacent properties and right-of-way. During and after construction the project is <br />subject to the noise regulations as set forth in EMC Chapter 20.08. <br />31. The Applicant shall contribute 20/0' of the value of the project to the City for off -site <br />public access improvements. Credit shall be given for on -site improvements <br />including the dedicated path, view platform, and two parking spaces. <br />32. Staging of construction equipment and materials shall be conducted outside of <br />the buffer area. Activities within the buffer shall be limited to those necessary to <br />implement the enhancement plan. <br />33. A plan for handling and storage of fuel, chemicals, oil, debris, and other <br />substances shall be drafted. The Applicant shall develop, and be prepared to <br />15 <br />
