Dunlap Towing Company <br /> SMA 3-90 <br /> -le -2-4,7 <br /> After due consideration of the testimony and evidence presented by the <br /> Applicant; testimony and evidence elicited during the public hearing; and as <br /> the result of the personal inspection of the subject property and surrounding <br /> areas by the Everett Hearing Examiner, the following findings of fact and <br /> conclusions constitute the basis of the decision of the Everett Hearing <br /> Examiner. <br /> FINDINGS OF FACTS <br /> 1. The Applicant requested approval of a Shoreline Management Substantial <br /> Development Permit pursuant to the provisions of EMC Chapter 20.12. The <br /> request is for the development of a wood chip handling facility on a <br /> five acre site adjacent to the Snohomish River located at 615 Ross <br /> Avenue, Everett, Washington. The proposal includes: <br /> a. Removal of existing buildings and debris on-site; <br /> b. The filling of approximately 75% (.6 acres) of two existing ponds; <br /> c. The regrading of the entire site and the replanting of areas that <br /> will not be asphalted; <br /> d. The asphalting of approximately 80% of the site to provide space <br /> for truck parking for chip loading and storage; <br /> e. The importation of up to 9,000 cubic yards of dredged spoils to <br /> flood proof the site; <br /> f. The installation of a conveyor and rotating telescoping loading <br /> spout that will be mounted about 58 feet above grade and used to <br /> transfer chips for a distance of about 130 feet over water to <br /> barges docked in the Snohomish River; <br /> g. Bank stabilization along the shoreline and enhancement of natural <br /> vegetation to provide habitat for wildlife; <br /> h. Construction of a 500 square foot office building; and <br /> i. Installation of dolphins for protection of the piers in the area. <br /> 2. The subject property, located within the City of Everett, was annexed <br /> into the City in 1983. However, the Everett Master Program that is part <br /> of the shoreline review has not been amended and updated, and as a <br /> result, the governing master program for the proposed project is the <br /> Snohomish County Shoreline Master Program (hereinafter referred to as <br /> Program). <br />
