The Applicant submitted <br /> that an oil/water separator will be implemented as part of the storm <br /> drainage control. All storm water runoff will be directed through a <br /> grass lined swale with a detention pond on-site. The swale should <br /> adequately filter the water to provide for water quality. <br /> 38. An adjoining property owner who operates Dagmar's Landing was concerned <br /> about the dust from the chip storage. The City submitted that it did <br /> not anticipate that the Applicant would have a problem with dust, but if <br /> a dust problem arises, a water fog spray system must be installed. The <br /> City will establish the standards for the determination of such a <br /> system. <br /> 39. The Everett Planning Department recommended approval of the Shoreline <br /> Management Development Permit subject to conditions as set forth in the <br /> staff report. <br /> CONCLUSIONS <br /> 1. The application is for the approval of a Shoreline Management <br /> Development Permit pursuant to City Ordinance 723-80, as amended, for a <br /> wood chip handling facility on a five acre site adjacent to the <br /> Snohomish River located at 615 Ross Avenue, Everett, Washington. The <br /> specific project's description of the proposal is set forth in the <br /> finding #1 of this document. <br /> 2. A Shoreline Management Development Permit is required pursuant to RCW <br /> 90.58.140(2). The Permit is required because of the project's close <br /> proximity to the Snohomish River; the development will occur on a <br /> shoreline as defined in RCW 90.58.030; and, the development is a <br /> substantial development as defined in RCW 90.58.020. <br /> 3. The proposed development is a substantial development as defined in the <br /> Shoreline Management Act of 1971. The Snohomish River is a shoreline <br /> recognized under the terms of the Shoreline Management Act of 1971. <br /> 4. Accordingly, the Applicant must obtain a Shoreline Management <br /> Substantial Development Permit for the proposed development of the <br /> site. <br /> 5. Ordinance 1122-85, Section 7, as amended, establishes criteria for the <br /> issuance of Shoreline Management Substantial Development Permit. The <br /> Permit may be granted only when the development proposed is consistent <br /> with: <br /> a. the policies and procedures of the Shoreline Management Act of <br /> 1971; <br /> b. the Department of Ecology Shoreline Management Guidelines of 1972; <br />
