Company <br /> SMA 3-90 <br /> ge -8- / <br /> c. the Everett Shoreline Master Program (the Snohomish County Master <br /> Program because the Everett Shoreline Master Program has not been <br /> amended to include the subject property); and, <br /> d. the State Environmental Policy Act. <br /> With the conditions of approval as set forth in this document, the <br /> proposed development of this site will satisfy the criteria of these <br /> Acts. <br /> 6. The City of Everett Ordinance 1122-85, Section 10-2, grants the Everett <br /> Hearing Examiner jurisdictional authority on the Shoreline Management <br /> Development Permit request. Ordinance 1122-85, Section 12(C), grants <br /> the Everett Hearing Examiner the authority to attach conditions, <br /> modifications, and/or restrictions on the location, character, and other <br /> features of the proposed development. <br /> 7. The Snohomish County Master Program designates the subject property as <br /> Urban Environment. ,With conditions, the development satisfies the <br /> goals, policies, and criteria of the Urban designation. <br /> 8. There is no public access to the shoreline. Because of the nature of <br /> the activity and the limited space available for the public to be <br /> provided an access in a safe manner, no public access is required. <br /> 9. The proposed development will be developed consistent with the zoning <br /> laws of the City of Everett. In situations where the zoning laws <br /> conflict with the Shoreline Master Program, the provisions of the Master <br /> Program supersede the zoning ordinance. <br /> 10. The site contains wetland areas. Pursuant to review, no development <br /> shall occur in these wetlands. <br /> 11. The two man-made ponds on-site are not wetlands. The restrictions of <br /> the Corps of Engineers will apply to the development of that area of the <br /> site. <br /> 12. Pursuant to the State Environmental Policy Act, a mitigated Declaration <br /> of Non-Significance was issued for the project. <br /> DECISION <br /> Based upon the preceding findings of facts and conclusions, the testimony and <br /> evidence submitted at the public hearing, and upon the impressions of the <br /> Hearing Examiner of the City of Everett upon a site view, it is hereby ordered <br /> that the requested Shoreline Management Development Permit for property <br /> located at 615 Ross Avenue, Everett, is approved pursuant to the following <br /> conditions: <br />
