action must be accomplished. A copy of the City's Noise Control regulations can be found <br /> online at www.everettwa.gov. <br /> 7. All shipping/storage containers must be removed from the site. The covered loading area <br /> either needs to be removed or rebuilt with required construction permits. <br /> 8. Landscaping. The R-1 zone requires Category B landscaping for nonresidential uses. A <br /> landscape plan is required at the time of building permit submittal meeting the <br /> requirements of Category B and Chapter 35 Landscaping. A 2 year maintenance assurance <br /> device is required following the approval of installed landscaping. Assurance device forms <br /> are available for pick-up at the Permit Services counter upon request. All public rights-of- <br /> way shall also be landscaped to Type III standards, except that trees are not required. <br /> At a minimum, the following landscaping is required along all lot lines except for <br /> approved driveways: <br /> a.) North lot line— 10 feet of Type I or 15 feet of Type II <br /> b.) South lot line — 10 feet of Type III (except for parking parallel to the street as shown in <br /> the site plan dated 3/6/2015) <br /> c.) ..of line— 10 feet of Type I or 15 feet of Type II <br /> d.) cirest..lot line — 10 feet of Type III (except for existing paved head-in parking spaces in <br /> 'the front) <br /> 9. Any dumpsters, garbage cans, and recycling bins must be enclosed within a solid fence <br /> enclosure so as to not be visible from adjoining properties or city right-of-way. This must <br /> be placed on private property, not obstruct a required parking space and the location <br /> approved by the City. The metal chip storage containers must be stored inside the building. <br /> 10. Hours of Operation and Employee Maximum: The machine shop is restricted to a 12 hour <br /> work day and 6 days a week as was previously certified under the cabinet shop NCU#3- <br /> 87. The maximum number of employees is limited to 18. <br /> Subsection 38.030.0 allows an applicant to propose and the Planning Director (using Review <br /> Process 11) to approve a nonconforming use to be changed to another use only if such use is not <br /> more nonconforming than the existing nonconforming use,that the nonconforming use has not been <br /> discontinued for a period of more than two years, and that the new use satisfies the evaluation <br /> criteria contained in Subsection 38.090A of the City of Everett Zoning Code. The evaluation <br /> criteria are as follows: <br /> I. The impact of traffic generated by the proposed use on the surrounding area,pedestrian <br /> circulation and public safety, and the proposal's ability to mitigate potential impacts. <br /> Findings: The Applicant states that the machine shop will have similar traffic impacts of the <br /> previous cabinet shop. The Traffic Engineering division is not requiring additional mitigation <br /> for the change of use. Pedestrian circulation will remain the same.
