5. The public will benefit from the redevelopment of this sand and gravel mine into an <br /> office and industrial park with some small scale retail activities, as envisioned by <br /> CSR and FSA; and <br /> 6. The surrounding property and neighborhoods will not be detrimentally affected by the <br /> changes to the regulations; and <br /> 7. The public will benefit from the dedication of 64 acres of CSR Associated property <br /> for use as a recreation facility and from the higher quality of the development <br /> provided by the PDO; and <br /> 8. The proposed changes to the M-1 Zone for this property bear a substantial relation to <br /> public health, safety or welfare; and promote the best long term interests of the <br /> Everett Community; and <br /> 9. The proposed rezone meets all of the criteria in Chapter 41, Subsection160 D.4 of the <br /> Zoning Code. <br /> 10. The proposed rezone shall be implemented through a Development Agreement as <br /> provided in RCW 36.70B.170. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF EVERETT: <br /> Section 1: PDO Approval. <br /> That the Everett City Council Approves the Planned Development Overlay Zone (PDO) <br /> for the CSR and FSA property as described in Exhibit 1 which is attached hereto and <br /> incorporated herein by reference. <br /> Section 2: Modification of Regulations. <br /> That in accordance with the PDO Approval provided in Section 1, that the following <br /> regulations to the M-1 Zoned property, as described in Exhibit 1, are hereby modified as <br /> follows: <br /> 1. Definitions: <br /> a. The Property: All of the property owned by CSR Associated and Food Services <br /> of America located west of Glenwood Avenue. <br /> b. External Roads: Glenwood Avenue, Merrill Creek Parkway, Hardeson Road, & <br /> Sievers-Duecy Boulevard. <br /> c. Internal Roads: All roads on the property other than the External Roads. <br /> d. External Lots: All lots having any frontage on an External Road. <br /> e. Internal Lots: All lots other than External Lots. <br /> 3 <br />
