10. Repairs. Landlord shall, at its own expense, repair and maintain the Building, <br /> Premises, and Common Areas, and the plumbing, heating, ventilating, air conditioning, <br /> elevator and electrical system installed or furnished by Landlord in good condition and <br /> repair and in a condition similar to that found in similar Class A buildings in the Everett <br /> "Retail Office Core" as defined by MUP No. 28-5, City of Everett Zoning Code, 1/13/90 <br /> issue. Any such maintenance and repair costs shall be Landlord's responsibility, unless <br /> such maintenance and repairs are caused in part or in whole by the act, neglect or <br /> omission of any duty by Tenant, its agents, employees, sublessees, licensees, or invitees, <br /> in which case Tenant shall pay to Landlord, as Additional Rent, that portion of the cost of <br /> such maintenance and repairs attributable to the act, neglect, or omission of Tenant, its <br /> agents, employees, sublessees, licensees or invitees. <br /> 11. Liens. Tenant shall not permit any mechanics', materialmen's, or other liens to be <br /> filed against the Building nor against Tenant's leasehold interest in the Premises. <br /> Landlord shall have the right at all reasonable times to post and keep posted on the <br /> Premises any notices which it deems necessary for protection from such liens. If any such <br /> liens are filed, Tenant shall have ten (10) days from the date of such filing in which to <br /> either remove such liens or to provide a bond indemnifying Landlord from said lien in the <br /> amount of one hundred fifty percent (150%) of the claimed lien amount. If Tenant fails to <br /> take such measures in the time allowed, Landlord may, without waiving its rights and <br /> remedies based on such breach of Tenant and without releasing Tenant from any of its <br /> obligations, cause such liens to be released by any means it shall deem proper, including <br /> payments in satisfaction of the claim giving rise to such lien. Tenant shall pay to Landlord <br /> at once, upon notice by Landlord, any sum paid by Landlord to remove such liens, <br /> together with interest at a rate equal to the prime commercial rate of interest as published <br /> from time to time by Frontier Bank, Everett, Washington, plus two percent (2%), which <br /> interest rate shall apply from the date of such payment by Landlord until repaid by <br /> Tenant. <br /> 6 <br /> I <br />
