6 <br /> (b)The per day storage rate in 3.2(d) shall be no higher than the applicable Cap Rate set by the Washington <br /> State Patrol for the applicable region and in effect at the time of the impound authorization. <br /> (c) The Proposer's response fee in 3.2(f)shall be no more than 50 percent of the Proposer's impound fee in the <br /> event that a person arrives and properly claims his/her vehicle. The Proposer shall not leave the impound <br /> location with the impounded vehicle in tow if there is reasonable cause to believe that the owner or a person <br /> authorized by the owner is approaching. The Proposer shall release a vehicle if the approaching person <br /> provides reasonable proof of ownership or authorization to operate the vehicle. <br /> (d)The Proposer's rates for all the services referenced in 3.2 must take into account EPD's requests for tows of <br /> abandoned vehicles. For the purpose of Proposal evaluation only,assume that abandoned vehicles <br /> represent 23% of the 852 tow requests per year for Impound Zone 1 and 7% of the 1187 tow requests per <br /> year for Zone 2. <br /> 3.4 Alternative Rates in Event the City Reduces the Scope of the RFP <br /> a. The Proposer must propose alternative rates for the services referenced in 3.2, assuming, for the <br /> purpose of Proposal evaluation only, that EPD will not request tows of abandoned vehicles. The City <br /> may consider these alternative rates in the event that the City elects to remove towing and impoundment <br /> of abandoned vehicles from the scope of services required. Nothing in this Section shall be construed <br /> to obligate the City to consider removing abandoned vehicles from the scope of services required of the <br /> Successful Proposer. <br /> b. The Proposer must also propose alternative rates for the services referenced in 3.2, assuming,for the <br /> purpose of Proposal evaluation only,that EPD will not request tows of city-owned and evidence vehicles. <br /> The City may consider these alternative rates in the event that the City elects to remove towing and <br /> impoundment of City-owned and evidence vehicles from the scope of services required. Nothing in this <br /> Section shall be construed to obligate the City to consider removing City-owned and evidence vehicles from <br /> the scope of services required of the Successful Proposer. <br /> 3.5 Use of Appropriate Class Truck to Tow <br /> The Proposer's rates for the services referenced in 3.2 must take into account that for Class A/D vehicles,the <br /> Class A/D rate applies regardless of whether a Class B/E truck is used to tow. The rates set forth in thePrice <br /> Sheet at Proposal Form B are not expected to apply in cases where a vehicle owner requests towing to a <br /> location other than a tow company's impound/storage lot. In such cases,the tow company's posted rates shall <br /> apply. <br /> 3.6 Business Office Within City Limits Required <br /> The Proposer must have a business office within City limits and within one of the two Impound Zones the <br /> Proposer proposes to serve. <br /> 3.7 Proposer's Primary Storage Lot <br /> 22 <br />
