I10 11 In all disputes concerning accuracy of lines and elevations, the Contracting Agency shall 12 be assumed correct and the Contractor shall correct the discrepancies before ( 13 construction work may proceed. No additional compensation shall be paid for this � 14 corrective work. 15 I 16 Payment 17 All labor, materials, tools, and equipment necessary to perform the work as specified, 18 shall be included in the lump sum price for"Surveying". � 19 20 21 Section 1-10 TEMPORARY T12AFFIC CONTROL ( 22 1-10.1 General 23 The Contractor shall provide fiaggers, signs, and other tra�c control devices not � 24 otherwise specifi�d as being furnished by the Contracting Agency. The Contractor shall 25 erect and maintain all construction signs, warning signs, detour signs, and other traffic 26 control devices necessary to warn and protect the public at all times from injury or ( 27 damage as a result of the Contractor's operations which may occur on highways, roads, 28 or slreets. No work shall be done on or adjacent to the roadway until all necessary signs 29 and traffic control devices are in place. 30 ' 31 These flaggers, signs, and other traffic control devices shall be used for the safety of the 32 public, the Contractor's employees, and Contracting Agency's personnel and to facilitate 33 the movement of the traveling public. They may be used for the separation or merging of I 34 public and construction traffic when in accordance with a specific approved tra�c control 35 plan. 36 I 37 Upon failure of the Contractor to immediately provide flaggers; erect, maintain, and 38 remove signs; or provide, erect, maintain, and remove other traffic control devices when 39 ordered lo do so by the Engineer, the Contracting Agency may, without further notice to ' 40 the Contractor or the Surety, perform any of the above and deduct all o( the costs from 41 the Contractor's payments. 42 � 43 The Contractor shall be responsible for providing adequate fiaggers, signs, and other 44 traftic control devices for the protection of the work and the public at all times regardless 45 of whether or not the (laggers, signs, and other traffic control devices are ordered by the 46 Engineer, furnished by the Contracting Agency, or paid for by the Contracting Agency. � 47 The Contractor shall be liable (or injuries and damages to persons and property suffered 48 by reason of the Contractor's operations or any negligence in connection therewith. 49 � Port of Everett FAWAT-03019 Satellite RaillBarge Transfer Facility Final Port Review Draft � Phase 1:Pier Construction 28 15 March 2005
