Reject Mixture <br /> I 19 <br /> 20 1. Rejection by Contractor. The Contractor may, prior to sampling, <br /> 21 elect to remove any defective materiai and replace it with new <br /> � 22 material at no expense to the Contracting Agency. Any such new <br /> 23 material will be sampled, tested, and evaluated for acceptance. <br /> 24 <br /> � 25 2. Rejec;ion Without Testing. The Engineer may, without sampling, <br /> 26 reject any batch, load, or section of roadway that appears <br /> 27 defective in gradation or asphalt binder content. Material rejected <br /> 28 before placement shall not be incorporated into the pavement. <br /> I 29 Any rejected section of roadway shall be removed. <br /> 30 <br /> 31 No payment will be made for the rejected materials or the removal <br /> 32 of the materials unless the Contractor requests that the rejected <br /> 33 material be tested. If the contractor elects to have the rejected <br /> 34 material tested, a minimurt; of three representative samples will <br /> 35 be obtained and tested. Acceptance of rejected material w�ll be <br /> ; 36 based on confortnance with the statistical acceptance <br /> 37 specification. If the CPF for the rejected material is less than 0.75, <br /> 38 no payment will be made for the rejected material, and in addition, <br /> � 39 the cost of sampling and testing shall be bome by the Contractor. <br /> � 40 However, if the CPF is greater ihan or equal to 0.75, the cost of <br /> � 41 sampling and testing will be bome by the Contracting Agency and <br /> ! 42 the HMA will be compensated at a CPF of 0.75. If rejection occurs <br /> 43 after piacement and the CPF is greater than 0.75, compensation <br /> 44 for the rejected HMA will be at the calculated CPF with an <br /> I 45 addition of 25 percent of the unit contract price added for <br /> 46 placement and removal costs. <br /> 47 <br /> I 48 3. A Partial Sublot. In addition to the preceding random acceptance <br /> 49 sampling and testing, the Engineer may also isoiate from a <br /> 50 normal sublot any material that is suspected of being defective in <br /> � 51 gradation or asphalt binder content.
