The construction <br />cf the Ftoposed uCilities as noted in Finding #2 are an <br />allowed use in a Rural Environment. ihey musr, however, <br />comply with Che genecal requirements rela�.ed to the <br />uCility section of the Snohomish County Master Program. <br />(Ervine tesCimony) <br />Impcovemenls of the sewer facilities were proposed by <br />�.he City of Everett in 1984. At that time the proposal, <br />as submitted, was to use approxima�_ely lU0 acres of <br />wetlands. Subsequent to lhe approval, the Department of <br />Ecology modified standard:, and Lhe City redesigned i�.s <br />proposal. Thus the original proposal is no longer valid <br />and the City has redesigned a new facility using 7.7 <br />acres of land. This is a significant reduction in i.he <br />amount of wellands to be developed by Lhe proposal. <br />(Ervine testimony) <br />RCW 90.58 sets fo�th the Shoreline Management Acl of <br />1971 for the Stat.e of Washington. RCW 90.58.140(2) <br />requires that no subsCanCS.al development shall be <br />undertaken on shorelines in the Stale of Washingtor. <br />withouC a permit from the governmen� entity having <br />edminislrative jurisdic+_ion. A substantial development <br />is defined as a developmenl which Che kotal cosLs of <br />fair market value exceed $1,000.00 or any development <br />which malerially interferes wiCh the normal public use <br />of tiie waker or shorelines of lhe stale (RCW <br />90.58.030(3)(E).
