Pecmit for construc+_ion of the <br />proposed developmen�_. <br />Ordinance A1122-85, Sec�_ion 7, establishes t_he ccitecia <br />for t,he iss�ance of a Shoreline Subslantial Developmen+_ <br />Permil. The permit �nay be gran�_ed only when �_he <br />developmenl proposea is consis�_ent with: <br />(a) the policies and procediires <br />of 1971; <br />(b) the Depar�_menl of Ecology <br />Guidelines of 1972; <br />(c) <br />(d) <br />of the Shoreline Acl <br />Shoreline Manageme M: <br />the Everett Shoreline Masler Program; and <br />t:�e Slale Environment Policy Ac�.. <br />With conditions of approval, the proposed development <br />salisfies Chese criteria. <br />5. The City of Everett Ordinance #].122-85, Sec�.ion 10(2), <br />grants the Everett Hearing Examiner the jurisdictional <br />auChorily to hold a hearing and to make a decision on <br />the Shoreline Substanr_ial Development Permik reques+.. <br />Ordinance �1122-85, Sec�.ion 12(C), grants lhe Everet? <br />Hearing Examiner authoriky to aCtach conditions, <br />modif.icalions, and/or restriclions on the loca�_ion, <br />character, or other features of lhe proposed development <br />thaC ace necessary to make the permit and development <br />compatible with t.he criteria as se+_ EorCh in Section 7 <br />of Ordinance #1122-85. <br />6. The Cily of Everett has annexed +_he subjec+. prop=rt_y. <br />However, the local Shoreline Master Program of lhe City <br />of Everelt has not been amended to include �.he <br />properCy. Thus, acco�ding ko WAC 173-19-0009 the Cily <br />is authorized lo review the proposal pursuant to the <br />Snohomish County MasCer Program. <br />The Snohomish County Shoreline Master Program designates <br />the subject propert;� as Rural Environment which permirs <br />lhe const_ruction of the u�_iliky far_iliCy as reques�.ed. <br />
