Should any of the northern portion of the subject <br />property be developed, the City of Everett has reserved <br />the right to impose engineering requirements. <br />31. The Applicant testified to be in agreement with the <br />recommendation for the proposed rezone. In addition, <br />the Applicant testified to be in total agreement with <br />the Concomitant Agreement for the development of the <br />southern portion of the proposed rezone. <br />32. A witness (Chism) testified that parking is a problem on <br />Lenora and South First Avenue. The witness was <br />concerned wh:?cher the development of the southern <br />portion of. the subject property would create additional <br />parking. The Applicant testified that the structure <br />will not create any additional parking problems in the <br />area and will alleviate many of the existing problems by <br />providing a more orderly system of parking for <br />administrative workers of the Applicant. <br />33. The witi,ess (Chism) requested that the Applicant be <br />prohibited from conducting any retail sales or similar <br />activity of pornographic materials on' land that is <br />subject of the rezone. <br />34. The witness (Chism) testified to be a representative of <br />the Lowell Civic Association. Another witness <br />(Spurling) is also a member of the Lowell Civic <br />Association. <br />35. The witness (Spurling) requested that- a bicycle path be <br />included as part of the landscaping of the subject <br />property as it fronts Lenora. According to the witness, <br />a significant portion of surrounding properties are part <br />of a bicycle path that will be developed in the summer <br />of 1984. The extension of the path in fr,)nt of the <br />Applicant's property is a benefit to the community a -id <br />to the Applicant. <br />36. The Applicant testified to be in support of the <br />recommendation of the witness (Spurling) that the <br />bicycle path be part of the landscaping. The City of <br />Everett had no comment on the bicycle path. Subsequent <br />to the, hearing, the Everett Public Works Department <br />submitted that the widening of Lenora to include a <br />bicycle path and to provide for adequate vehicle and <br />pedestrian movement was acceptable to the City of <br />Everett. <br />37. No adverse testimony was received on the requested <br />rezone. <br />
